1968-348RESOLUTION NO. 68R -348 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1028 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from G. L. HARBOUR, 4500 Orrington Road, Corona Del Mar, California, to establish a 15 -unit, planned residential development, on the property hereinafter described, with a waiver of the minimum dis- tances between buildings (Section 18.28.050(7 -a) of the Anaheim Municipal Code). Said property is situated in the City of Anaheim, County of Orange, State of California, and is more particularly described as follows, to wit: That portion of the fractional Northwest quarter of Section 2, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in Book 51, page 10, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the Southwest corner of the East one -half of the East one -half of the fractional Northwest quarter of said Section 2; thence North 89° 59' 45" West along the South line of the North- west one quarter of said Section 2, Township 4 South, Range 10 West a distance of 228.63 feet to the Southeast corner of the land described in Deed to the State of California, recorded March 19, 1959, in Book 4632, page 181 of Official Records; thence along the boundary of said land to the State of California, the follow- ing courses and distances: North 0° 00' 15" East 29.97 feet to the beginning of a curve concave Northerly having a radius of 38.00 feet, a radial line through said point bears South 0° 00' 15" West; thence Westerly along said curve through a central angle of 48° 48' 43" an arc distance of 32.37 feet to the beginning of a reverse curve concave Southerly having a radius of 44.00 feet; thence Westerly along said curve through a central angle of 62° 43' 56" an arc distance of 48.17 feet to a point in the Southerly line of the Orange County Flood Control Channel, 65.00 feet wide; said point being a point in a curve in said Southerly line concave Northwesterly having a radius of 527.50 feet, a radial line through said point bears South 47° 55' 04" East; thence Northeasterly along said curve through a central angle of 10° 57' 57" an arc distance of 100.96 feet to the beginning of a reverse curve in said South- erly line, concave Southeasterly having a radius of 472.50 feet; thence Northeasterly along said curve through a central angle of 38° 01' 21" an arc distance of 313.56 feet to the West line of said East one -half of the East one -half of the Northwest quarter; thence South 0° 46' 46" East 335.01 feet to the point of beginning. AND WHEREAS, the City Planning Commission did. hold a public hearing at the City Hall in the City of Anaheim upon said application on Mav 20 1968 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC68 -140 4kmapoulo. granting Conditiofial Use Permit No. 1028, spect ct to the conditions therein set forth -1- WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said conditional use permit and did thereupon fix the 25th day of June 19 68 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful conside- ration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission granting said conditional use permit be, and the same is hereby sustained and that Conditional Use Permit No. 1028 be, and the same is hereby, granted permitting the establishment of a 15 -unit, planned residential development on the property hereinbefore described, with a waiver of the minimum distances between buildings (Section 18.28.050 (7 -a) of the Anaheim Municipal Code), and subject to the follow- ing conditions: 1. That this conditional use permit is granted subject to the completion of Reclassification Proceedings No. 67 -68 -85 now pending. 2. That trash storage areas shall be provided in accor- dance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building and zoning inspections. 3. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building and zoning inspections. 4. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1 and 2; PROVIDED, HOWEVER, that Blossom Lane is cul -de- saced and the parking area is revised as necessary and still complies with Code parking requirements. 5. That the alley shall remain a private alley; PROVIDED, HOWEVER, that dedication shall be made to the City of Anaheim of the necessary easements for City services. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
