1968-339RESOLUTION NO. 68R 339 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 1019 WHEREAS, the City Planning Commission of "the City of Anaheim did receive a request for a conditional use permit from Edward W. Simoneaux, Jr. and Vivian A. Simoneaux, 604 N. Magnolia Avenue, Anaheim, California; Ephren Laplante and Rose Alba Laplante, 608 N. Magnolia Avenue, Anaheim, California; and Emily E. O'Keefe, 612 N. Magnolia Avenue, Anaheim, California, to establish an automobile service station within 75 feet of a residential zone, on the property hereinafter described, with a waiver of the maximum building height limitation within 150 feet of a single family residential zone boundary (Section 18.40.070(3) of the Anaheim Municipal Code). Said property is situated in the City of Anaheim, County of Orange, State of California, and is more particularly described as follows: Lots 15, 16 and 17 of Tract No. 2118 as shown on a map recorded in Book 63, Pages 36, 37 and 38 of Miscellaneous Maps, records of Oran ge County, California. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of.Anaheim upon said request on April 8, 1968 notices of which said public hearing were duly given as Marred by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC68 -106 denying Conditional Use Permit Mo. 1019 and WHEREAS, thereafter, within twenty date of the adoption of said resolution, the elect, upon its own motion, to review the ac Planning Commission in denying said permit and did thereupon fix the 7th 1968 as the time and the Council Cham -1- two days from the City Council did tion of the City conditional use day of M v in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 1019 should be denied. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion de wingg Conditional Use. Permit No. 1019 be, and the same is hereby sustained and that the request of Edward W. Simoneaux Jr. and Vivian A. Simoneaux; Ephren Laplante and Rose Alba Laplante; and Emily E. O'Keefe for a conditional use permit to establish an automobile service station within 75 feet of a residential zone, on the property hereinbefore described,with a waiver of the maximum building height limitation within 150 feet of a single family residential zone (Section 18.40.070 (3) of the Anaheim Municipal Code), be, and the same is hereby denied.
