1968-335RESOLUTION NO. 68R- 335 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE GRANTING OF AN EASEMENT TO SOUTHERN CALIFORNIA EDISON COMPANY FOR AN ELECTRICAL SYSTEM; AND AUTHORIZING THE EXECUTION OF SAID GRANT OF EASEMENT. WHEREAS, the Southern California Edison Company has requested an easement and right of way to construct, use, main- tain, alter, add to, repair, replace, reconstruct, inspect and /or remove at any time and from time to time, an electric system consisting of underground conduits, preformed cable in ducts, vaults, manholes, pull boxes and including above ground transformers, pedestals, markers and concrete pads and other appurtenant fixtures or equipment, together with the wires, cables, switches and appurtenances as are now and which may be- come necessary or useful for conveying electric energy to be used for light, heat, power, telephone, telegraph and /or other purposes, in, on, under and across the real property herein- after described; and WHEREAS, the City Council finds that the granting of such easement and right of way in, on, under and across the hereinafter described property for the purposes above set forth will not interfere with any other contemplated public use of said property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that there be, and there is hereby, granted to Southern California Edison Company, a corporation, its suc- cessors and assigns, an easement and right of way to construct, use, maintain, alter, add to, repair, replace, reconstruct, inspect and /or remove at any time and from time to time, an electric system consisting of underground conduits, preformed cable in ducts, vaults, manholes, pull boxes and including above- ground transformers, pedestals, markers and concrete pads and other appurtenant fixtures or equipment, together with the wires, cables, switches and appurtenances as are now and which may be- come necessary or useful for conveying electric energy to be used for light, heat, power, telephone, telegraph and /or other purposes, in, on, under and across the following described real property, situated in the County of Orange, State of California: A strip of land six (6) feet in width lying within Lot 16 of Orangewood Tract, as per map recorded in Book 7, page 42, of Miscellaneous Maps, in the office of the Recorder of said County, the centerline of said strip is described as follows: Beginning at a point in the southerly line of said Lot 16, distant 357 feet easterly, measured along said southerly line from the easterly line of Haster Street, as shown on map filed in Book 63, page 5, of Record of Surveys, in the office of the Recorder of said County; thence, northwesterly a distance of 20 feet to a point hereinafter referred to as Point "A" located 8 feet northerly, measured at right angles from said southerly line of Lot 16. Also, a strip of land ten (10) feet in width, the cen- terline of said strip being described as follows: BE IT FURTHER RESOLVED that Southern California Edison Company, its employees, contractors and agents, shall have free access to said electric system and all portions thereof at all reasonable times and at any time when necessary for the purpose of exercising the rights herein granted and shall have the right to trim or cut the roots of such trees, shrubs or plants as, in the opinion of said Edison Company, may endanger or interfere with said electric system, provided, however, that in making any excavations on any part of said property said Edison Company, its employees, contractors and agents, shall make such excavations in a manner as will cause no unreasonable damage to the surface of the earth around said excavation and shall replace the earth so removed and restore the surface of the ground as near as practicable to the condi- tion it was prior to such excavation. BE IT FURTHER RESOLVED that the City of Anaheim and the successors and assigns of the City shall not erect, place or maintain, nor permit the erection, placement or maintenance of any building, wall, fence, planter box, earth fill or other structure in contact with, or so close to any part of said electric system so as to interfere, in the opinion of said Edison Company, with access to, or with the drainage of water away from, any part of said electric system which may be above ground, or otherwise interfere with or endanger said electric system or any part thereof. BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized to execute a Grant of Easement to carry out the purposes of this resolution and to complete the granting of said easement and right of way to the Southern California Edison Company. THE FOREGOING RESOLUTION is approved and signed by me this 18th day of June, 1968.
