A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM COMPROMISING CERTAIN EMINENT DOMAIN
LITIGATION; ACCEPTING A CERTAIN EASEMENT DEED;
AND AUTHORIZING AND DIRECTING PAYMENT THEREFOR.
WHEREAS, heretofore, on the 2nd day of March, 1967,
suit was filed in eminent domain to acquire certain easements in
connection with the construction of the Katella Avenue underpass
being entitled, "City of Anaheim vs. Charles R. Talmage, et ux.,
et al.," Orange County Superior Court Action No. 152093; and
WHEREAS, in compromise thereof, the City is in receipt
of an easement deed covering the permanent easement sought in
the aforementioned litigation and it is in the best interests of
the City of Anaheim to accept said easement deed for recordation;
and
WHEREAS, the Defendants, Charles R. Talmage and Phillis
M. Talmage have offered to settle said litigation for the sum of
$31,880, including all severance, temporary easement and other
damage; and
WHEREAS, the City Council finds that said sum is fair
and reasonable and that it would be in the best interests of the
City of Anaheim to accept such settlement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it accept, and it does hereby accept
the easement grant deed to the permanent easement sought in
Orange County Superior Court Action No. 152093, being entitled
"City of Anaheim vs. Charles R. Talmage, et ux., et al.," and
that the City Clerk be, and she is hereby directed to cause the
said deed to be recorded.
BE IT FURTHER RESOLVED that the City Council authorize
and direct, and it does hereby authorize and direct, the settle-
ment of said eminent domain litigation for the sum of $31,880.
BE IT FURTHER RESOLVED that the Finance Director be,
and he is hereby authorized and directed to draw a warrant in
the amount of $31,880 in favor of Charles R. Talmage and Phillis
M. Talmage; that said warrant be delivered to the office of the
City Attorney for transmittal, and that the charge be allocated
to Work Order No. 418 -A.
THE FOREGOING RESOLUTION is approved and signed by me
this 18th day of June, 1968.
