1968-328RESOLUTION NO. 68R 328 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1974 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from WALTER A. GOODEN and PAUL PLETZ, owners of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of Lot 3 of Helen and Lynch's Subdivision of a portion of the West one -half of Section 16, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, as shown on a map thereof re- corded in Book 51, page 7, et seq., Miscellaneous Maps, records of said Orange County and as shown on a map thereof recorded in Book 442, page 158, Deeds, records of Los Angeles County, California, described as follows: Beginning at a point 324.46 feet West of the Northeast corner of the Northeast quarter of the Northwest quarter of the North- west quarter, of said Section 16, and running thence South 661.49 feet to a point on the South line of said Northeast quarter 335.57 feet Easterly from the West line of said North- east quarter, said point being the true point of beginning of the boundary of the land herein described; thence West along said South line 335.57 feet; thence North along said West line 300.00 feet; thence East parallel to said South line 135.80 feet to a point on the Southerly prolongation of the West line of the land described in that certain memorandum of lease re- corded August 4, 1966, in Book 8009, page 942, Official Records of said Orange County; thence North 72.92 feet to the Southwest corner of the land described in said memorandum of lease; thence East along the South line of the land described in said memo- randum of lease and along the South line of the land described in a memorandum of lease recorded May 7, 1965, in Book 7512, page 702, Official Records of said Orange County, 200.00 feet to the East line of the land described in the deed to Paul H. Pletz and others recorded in Book 4339, page 415 of Official Records of said Orange County; thence South along said East line 372.92 feet to the true point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on May 6. 1968 notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18076 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC68 127 recommending that Variance No 1974 be granted, subject to certain conditions therein set forth and -1- WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 18th day of June 1968 at 1:30 o'clock P.M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the Provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preser- vation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting the establishment of a 76 unit, multiple £Zmily apartment complex, on the property here inbefore described,with waivers of the following Anaheim Municipal Code requirements, subject to the conditions hereinafter set forth: (a) A waiver of the minimum floor area of dwelling units (Section 18.28.050(3 -a)); (b) A waiver of the maximum distance of a living unit from a standard strEet (Section 18.28.050(9 -b)); and (c) A waiver of the minimum number of covered parking spaces for each dwelling unit (Section 18.28.050 (10 -a)). That the conditions subject to which this variance is granted are as follows: 1. That this variance is granted subject to the completion of Reclassification Proceedings No. 67 -68 -80 now pending. 2. That trash storage areas shall beFrovided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building and zoning inspections. -2- 3. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building and zoning inspections. 4. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1, 2 and 3. 5. That the proponents shall accept the perpetual mainte- nance of that part of the planter in the cul -de -sac by a method satisfactory to the City of Anaheim. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 18th day of June, 1968.
