A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEII APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT BETWEEN THE CITY
OF ANAHEIM AND THE COUNTY OF ORANGE, WITh
REFERENCE TO ROADyvAY IMPROVEMENTS ON BALL
ROAD BETWEEN 1320 FEET EAST OF STATE COLLEGE
BOULEVARD AND TILE SANTA ANA RIVER.
WHEREAS, the County of Orange is proposing to construct
roadway improvements on Ball Road between 1320 feet east of State
College Boulevard anti the Santa Ana River; and
WHEREAS, portions of the proposed irnprovement are in
the City of Anaheim; and
WHEREAS, the County and the City consider it in the best
interests of economics and public safety to combine the improve
ment in their respective jurisdictions into one project; and
WHEREAS, the County has offered to resign, contract and
inspect the City's portions of the proposed improvement; and
WHEREAS, A.i, th County of Orange has tendered to the City
a forril of agreement to be made and entered into between the
parties providing for the construction of the City's portion of
said improvement in conjunction with the County's construction
work and
WHEREAS, the City Council finds that the terms and con-
ditions of said agreement are fair and reasonable and that said
agreement should be ap; roves
NOW, THEREFORE, DE IT RESOLVED by the City Council of
the City of Anaheim that the agreement tendered to the City to
be made and entered into by any between the City of Anaheim and
the County of Orange, providing for the combined construction of
the County's and City's portions of the roadway improvements on
Ball Road between 1320 feet east of State College Boulevard and
the Santa Ana River, upon the following terms and conditions:
A. Be designated as Project Engineer, Contracting and
Construction Agent for the parties to do and perform
all things necessary in order to construct the pro-
posed improvement of Ball Road between 1320 feet east
of State College Boulevard and the Santa Ana River,
and to execute and deliver all documents required in
connection with the construction and completion of
said project, including Certificate of Cost and Cer-
tificate of Completion of Project.
During the period of construction have jurisdiction
over the construction area including that portion of
the project within the City area.
A. Approve the plans and specifications as they pertain
to construction and maintenance features for City's
portion of the project.

B. At all time during the progress of construction of
said project have access to the work thereon for the
purpose of inspection thereof i and should the City
deem any remedial measures to be necessary, it shall
notify the County thereof.
3. The total estimated cost for the City's portion is presently
$7,600.00, which sum includes an estimate of the engineering
and overhead for the portion.
4. The City's share of the construction cost shall be determined
on the basis of the amount of work done on said portion of
roadway lying within its boundaries, as these boundaries
exist at the time of advertising the project.
5. Upon completion of construction of said portion of pavement,
the County shall submit full, true and correct copies of
documents, certificates and itemized bills to the City and
the City shall reimbuse the County within thirty (30) days
upon submission of such costs. Such bills shall be based on
the actual quantities of construction and the unit prices
bid for the contract; and shall also contain a charge for
engineering and inspection based on the proportion of con-
tract cost for the portion within the City to the total con-
tract cost and the total engineering and inspection costs
plus a charge for overhead on the engineering and inspection
performed by the County, and exclusive of administrative
overhead.

BE IT FURTHER RESOLVED that the Mayor and City Clerk be,
and they are hereby authorized to execute said agreement for and
on behalf of the City of Anaheim.
