1968-274RLSOLUTIOiv NO. 68R- 274 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM COMPROMISI1'1G CERTAIN Ei1INENT DOI -AIN LITIGATION, ACCEPTING A CERTAIN EASEMENT DEED, AND AUTHORIZING AND DIRECTING PAYMENT THEREFOR. WHEREAS, heretofore, on the 15th day of April, 1968, suit was filed in eminent domain to acquire certain easements in connection with' the widening of Dale Avenue, being entitled, "City of Anaheim vs. Louis J. Myers, et ux., et al.," Orange County Superior Court Action No. 159615; and WHEREAS, in compromise of certain portions thereof, the City is in receipt of an easement deed covering Parcel 6 as described in said action, ani it is in the best interests of the City of Anaheim to accept said easement deed for recordation; and WHEREAS, in connection with said litigation, the City of Anaheim did deposit a certain sum with the County Clerk of the County of Orange as security for the taking of immediate bosses sion of saia parcel of land as follows: As to Parcel 6 $866.70 which the City Council hereby finds to be a fair and reasonable compensation for the easement taken; and WHEREAS, Melvin R. Bennett and Joyce M. Bennett are willing to accept the sum of $866.70 as settlement for Parcel 6. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it accept, and it does hereby accept an easement deed to Parcel 6 as the same is described in the com- plaint in Orange County Superior Court Action No. 159615, being entitled, "City of Anaheim vs. Louis J. Myers, et ux., et al.," and that the City Clerk be, and she is hereby directed to cause said deed to be recoraea. BE IT FU RT iE1. RESOLVED that the City Council authorize and direct, ant it does hereby authorize and direct, the settle- ment of saia eminent domain litigation (to the extent of said Parcel 6) for the sum of $866.70. BE IT FURTHER RESOLVED that the Finance Director be, and he is hereby authorized and directed to draw a warrant in the amount of $866.70 in favor of Melvin R. Bennett and Joyce M. Bennett; that saia warrant be delivered to the office of the City Attorney for transmittal. T±iE FOREGOING RESOLUTION is approved and signed by me this 21st day of May, 1963.
