1968-265RESOLUTION NO. 688 A RESOLUTION OF ThE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF ThE ANAHEIM iiiUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 67 -68 -70 to consider an amendment to Title 18 of the Anaheim municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones mentioned in said proposed amendment, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council as to a portion of the property described in said proposed amendment, and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 7th day of May, 1968, as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones set forth in said proposed amendment; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation, and did close said hearing and defer action thereon until May 21, 1968; and WHEREAS, on May 21, 1968, on motion duly made and seconded, said hearing was reopened to consider additional re- search which had been made in connection with said change of zone or zones and any new evidence which might be offered; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that Parcel "A" of the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as herein- after set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that PARCEL "A" of -1- 67 -68 -70 the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: PARCEL A The northerly 617.3 feet of the west half of the west half of the northeast quarter of the northwest quarter of Section 24, being a part of Lot 41 in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, County of Orange, State of California, as per map recorded in Book 2, pages 256 and 257 of Patents in the Office of the County Recorder of Los Angeles County, California. PARCEL °B" The west half of the west half of the northeast quarter of the northwest quarter of Section 24, being a part of lot 41 in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, County of Orange, State of California, as per map recorded in Book 2, pages 256 and 257 of Patents in the Office of the County Recorder of Los Angeles County, California. EXCEPTING therefrom the northerly 617.5 feet thereof. be excluded from County of Orange A -1, AGRICULTURAL DISTRICT zoning, and incorporated in R-3, MULTIPLE-FAMILY RRESIDENTIAL ZONE, upon the conditions hereinafter set forth; and that Parcel "B" above described remain in the zone in which it is now incor- porated, and that the reclassification to R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, be denied; that said Parcel "A" be changed to R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Ball Road, for street widening purposes. 2. That the owners of subject property shall deed to the City of Anaheim for street purposes, a strip of land 54 feet in width extending southerly from Bali Road ap- proximately 660 feet, except for the northerly 203 feet thereof, which shall be 55 feet in width, and being the easterly 54 feet of the westerly 55 feet of subject property, including 15 -foot radius corner returns at Ball Road and the proposed east -west street shown on Area Development Plan No. 94, Alternate B. 3. That the owners of subject property shall deed to the City of Anaheim a strip of land 50 feet in width along the southerly property line of Parcel "A for street purposes, and shall dedicate to the City of Anaheim all pedestrian and vehicular access rights to said street from Parcel "3 4. (a) That all engineering requirements of the City of Anaheim along Ball Road and the proposed east -west and north -south streets, hereinbefore mentioned, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by -2-- the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 5. That tine owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Ball Road and the proposed east -west and north -south streets, hereinbefore mentioned, for street lighting purposes. 6. That the owners of subject property shall pay to the City of Anaheim the sum of l5 per front foot along Ball Road and the proposed east -west and north -south streets, hereinbefore mentioned, for tree planting purposes. 7. That a parcel map to record the approved division of subject property shall be submitted to the City of Anaheim for approval and then recorded in the Office of the Orange County Recorder. 8. That the owners of subject property shall submit to the City of Anaheim an irrevocable offer of dedication for the westerly one foot, except for the northerly 203 feet, of subject property. A predetermined price for the one foot strip shall be calculated and agreed upon between the owners and the City of Anaheim prior to final building and zoning inspections. The cost of the one -foot strip shall include land and a proportionate share of the underground utilities and street improve- ments. 9. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be pain at the time the building permit is issued. 10. That a preliminary title report shall be furnished the City prior to the adoption of an ordinance reclassify- ing subject property, showing legal vesting of title, legal description and containing a may of subject property. 11 That ordinances reclassifying subject property shall be adopted as and when each parcel is ready to comply with conditions pertaining to such parcel; PROVIDED, HOWEVER, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved for a lot split by the City Council. 12. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building and zoning inspections. 13. That fire hydrants shall be installed as require and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building and zoning inspections. -3- 14. That the proposed north -south street shall be named Belhaven Street and the proposed east -west street shall be named Omega Avenue 15. That a six -foot masonry wall shall be constructed along the south property line of the street boundary, as shown on Area Development Plan No. 94, Alternate B; that reasonable landscaping with 15- gallon trees, including irrigation facilities, shall be installed the full dis- tance of said wall, plans for said landscaping to be submitted to and approved by the Superintendent of Park- way Maintenance; and that the owners of subject property shall enter into an agreement with the City to perpetu- ally maintain the abovementioned landscaped median, the agreement to be a covenant to run with the land; that this condition shall be complied with prior. to final building and zoning inspections. 16. That adequate easements, as determined_to be necessary by the City Engineer, shall be granted to the.City for sewers, drainage, and public utilities along the westerly property line of Parcel "B said easements to be granted prior to the approval of improvement plans for the improvement of Ball Road, Belhaven Street and Omega Avenue, by the City Engineer. ATTEST: 17. That Conditions Nos. 1, 2, 3, 4(b), 5, 6, 7 and 8 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
