1968-167RESOLUTION NO. 68R -167 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 67 -68 -52 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 26th day of Marph 19 68 the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter pet forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 67 -68 -52 The Northeast 8, Township 4 Coyotes, City Book 51, page County. quarter of the Southwest quarter of Section South, Range 10 West, in the Rancho Los of Anaheim, as shown on a map recorded in 10, Miscellaneous Maps, records of said Orange EXCEPTING THEREFROM any portion thereof lying Easterly of a line described as follows: Beginning at a 1 -1/4 inch iron pipe, with Licensed Surveyor's tag number L. S. 2477 set in concrete, said point being on the North line of said Southwest quarter, distant North 89° 43' 22" West, along said North line 660.07 feet from the Northeast corner of said Southwest quarter; thence South 0° 00' 19" West 1314.26 feet to a 1 -1/4 inch iron pipe, tagged L. S. 2210, said pipe being distant North 89° 36' 54" West 661.03 feet from the Southeast corner of the Northeast quarter, of the Southwest quarter of said Section 8. ALSO EXCEPTING THEREFROM any portion thereof lying within Tract No. 5053, as shown on a map thereof recorded in Book 183, pages 34 to 38 inclusive, Miscellaneous Maps, records of said Orange County. be excluded from R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, and in- corporated in M -1, LIGHT INDUSTRIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from from the center line of the street, along Crescent Ave- nue, for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim along Crescent Avenue, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a letter of intent or agreement in a form satisfactory to the City of Anaheim shall be filed with the City to guarantee the installation of said engineering require- ments on request of the City Engineer. Said agreement shall be approved as to form by the City Attorney. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Crescent Avenue, for street lighting purposes. 4. That the owner of subject property shall pay to the City of Anaheim the sum of 15 per front foot along Crescent Avenue, for tree planting purposes. 5. That Conditions Nos. 1, 2(b), 3 and 4, abovementioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. -2- 6. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building and zoning inspections. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building and zoning inspections. 8. That a six -foot masonry wall shall be constructed along the south property line prior to final building and zoning inspections; and that the owner of subject property shall dedicate to the City of Anaheim all vehicular access rights from the south boundary of subject property as it now or in the future may exist, said dedication to be made within a period of 180 days from date hereof, or such further time as the City Council may grant. 9. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent residential homes, prior to final building and zoning inspections. 10. That all external lighting on subject property shall be directed downward and away from abutting property lines, prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City. Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
