RESOLUTION NO. 77R -741
A RESOLUTION OF THE CITY COUNCIL OF TFIE CITY
OF ANAHEIM APPROVING THE TERMS OF AN AGREEMENT
BETWEEN THE CITY OF ANAHEIM AND DAVID E.
CUNNINGHAM COMPANY CONCERNING THE REIMBURSE-
MENT OF COSTS FOR SPECIAL WATER FACILITIES,
AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID AGREEMENT.
WHEREAS, David E. Cunningham Company has applied to the
City of Anaheim for water facilities to serve Tract 9749; and
WHEREAS, the City is unable to furnish water to said
Tract in the absence of special facilities as defined pursuant
to Rule No. 15 of the Water Rules of the City of Anaheim; and
WHEREAS, David E. Cunningham Company is willing to pay
the City its share of prior advances pursuant to said Rule No. 15
and the City is willing to attempt to collect from the ultimate
users of said special facilities, and /or persons within the Special
Facilities District No. 1, the fees necessary to reimburse David E.
Cunningham Company toward the cost of said special facilities; and
WHEREAS, an agreement has been prepared, the terms and
conditions of which are satisfactory to and in the best interests
of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of an agreement
between the City of Anaheim and David E. Cunningham Company con-
cerning the reimbursement of costs for special water facilities be,
and the same are hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are
hereby authorized to execute said agreement on behalf of the City
of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 15th day of November
1977.
