1977-739PESOLLTIOn :0. 77R- 739 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETEMINING THAT CER- TAIN CONDITIONS HAVE BEEN FULFILLED, AND ORDERING THE VACATION AND ABANDONMENT OF RN EASEMENT FOR PUBLIC ROAD PURPOSES SUBJECT TO CERTAIN PUBLIC UTILITY EASLUENT RESERVATIONS. (Palm Street) WHEREAS, the City Council of the City of Anaheim has elected to Proceed under the provisions of the Street Vacation Act of 1941 (Section 3300 et seg., Streets and Highways Code) in connection with requests for vacation and abandonment of Public streets within the City of Anaheim; and WHEREAS, the City Council did, by resolution duly posted and published, give notice of its intention to abandon the follow- ing described public street; to wit, Palm Street (hereinafter Paim Street) more specifically described as follows: That certain roadway, commonly known as Palm Street, located in the City of Anaheim, County of Orange, State of California, lying between Lots 27 and 28 of Anaheim Extension, as shown on a rap made by Wm. Hamel in 1863 filed in the office of the County Pe- corder of Los Angeles County, described as follows: Beginning at the southwest corner of said Lot 27, said corner being the centerline intersection of Ball Road and Palm Street; thence S 89° 46 30" W, 25.71 feet; thence 15° 57' 00" W, 591.10 feet, more or less, to an intersection with a line paral- lel with and 53.00 feet easterly of the centerline of Harbor Blvd., a radial line bearing S 84° 00' 59" E passes through said Point, said point of intersec- tion being a point in a curve concave northwesterly and having a radius of 1053 feet; thence Northeast- erly along said parallel line to an intersection with a line parallel along said curve through a central angle of 10° 21' 37" an arc distance of 190.40 feet to an intersection with a line parallel with and 30 feet easterly of the centerline of said Palm Street, a radial line bearing 1Z 35° 37' 25" N passes through said point of intersection; thence S 15° 57' 00" E, 259.20 feet; thence N 74° 03' 00" E, 2.00 feet to an intersection with a line parallel with and 32.00 feet easterly of the centerline of said Pali Street; thence S 15° 57' 00" E, 429.17 feet, more or less, to the be- ginning of a curve concave northeasterly and having a radius of 15 feet; thence Southeasterly and East- erly along said curve through a central angle of 75° 16' 30" an arc distance of 19.44 feet to an intersec- tion with a line parallel with and 53.00 feet north- erly of the centerline of Ball Road; thence S 0° 13' -1- (75-15A) WHEREAS, on the lst day of March, 1977, a public hearing was held to allow interested persons to submit evidence concerning said proposed abandonment; and WInEREAS, by Resolution No. 77R-144, uuly sassed and adop- ted on the lst day of ilarch, 1977, the City Council did determine that the street (Palm Street) above-described is unnecessary for present or prospective public use and did further determine that certain conditions should be met prior to making an order vacatina and abandoning said street; and WHEREAS, the City Council does hereby determine that the conditions set forth in Resolution 77R-144 have been fulfilled; and WHEREAS, the City Council does hereby determine that the Public convenience and necessity require the reservation and excep- tion of the public utility easements above-described in favor of the City of Anaheim, the Pacific Telephone Company and the Southern California Gas Company, subject to the prior rights of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby' order the vacation and abandonlent of Palm Street hereinabove described subject to the reservations of easements therein described which reservations in favor of the Pacific Telephone Company and the Southern California Gas Company are subject to the prior rights of the City of Anaheim. EL IT FURTHER TESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this Resolution and Order, attested by her under the seal of the City of Anaheim to be recorded in the Office of the County Recorder of Orange County, California. Excepting therefrom any portion thereof lying within Eall Road on the south (53.00-foot wide Half street). RESERVING UNTO the City of Anaheim, the Pacific Tele- phone Company, and the Southern California Gas Company a public utility easement over, under and across the easterly half of said Street as hereinabove described.
