A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN ENCROACHMENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH
MENT PERMIT WITH LUCAS DEVELOPMENT. (77 -6E)
WHEREAS, Lucas Development, a corporation,
hereinafter referred to as Licensee, is the owner of
property in the City of Anaheim over which the City owns a
public right -of -way; and
WHEREAS, Licensee wishes to encroach upon a
portion of said right -of -way for the purpose of permitting
the construction of three 18 -inch R.C.P. storm drain
connector pipes; and
WHEREAS, unless Licensee is allowed to encroach
upon the right -of -way of the City, an extreme and undue
hardship will be caused to it; and
WHEREAS, the proposed encroachment for such
installation across a portion of the right -of -way of City
will not interfere with the present use of the right -of-
way by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a
license agreement between the City of Anaheim and Lucas
Development, a corporation, be, and the same are hereby,
approved.
BE IT FURTHER RESOLVED that the Mayor and. City
Clerk be, and they are hereby, authorized to execute said
license agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted
by the City Council of the City of Anaheim this '1st day of
November 1977
