RESOLUTION NO. 77R- 718
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN ENCROACHMENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMIT WITH MAYER.CONSTRUCTIOII CORPORATION,
A CALIFORNIA CORPORATION. (76 -22E)
WHEREAS, Mayer Construction Corporation, a
California corporation, hereinafter referred to as Licensee
is the owner of property in the City of Anaheim over which
the City owns a public utility easement; and
WHEREAS, Licensee wishes to encroach upon a portion
of said easement for the purpose of construction and connec-
tion of a private 21 -inch R.C.P. storm drain to an existing
75 -inch R.C.P. City storm drain; and
WHEREAS, unless Licensee is allowed to encroach
upon the easement of the City, an extreme and undue hardship
will be caused to it; and
WHEREAS, the proposed encroachment for such instal-
lation across a portion of the easement of City will not
interfere with the present use of the easement by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a
license agreement between the City of Anaheim and Mayer
Construction Corporation be, and the same are hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said license
agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted
by the City Council of the City of Anaheim this 1st day of
November 1977.
