A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DELEGATING TO THE PUBLIC UTILITIES
BOARD OF THE CITY OF ANAHEIM THE AUTHORITY TO
CONDUCT HEARINGS PURSUANT TO THE PUBLIC
UTILITY REGULATORY POLICIES ACT OF 1978.
WHEREAS, the Congress has enacted the Public Utility
Regulatory Policies Act of 1978 (PURPA) for the purposes of (1)
conservation of energy supplied by electric utilties; (2) the
optimization of the efficiency of use of facilities and resources
by electric utilities; and (3) equitable rates to electric con-
sumers; and
WHEREAS, PURPA applies to each electric utility in any
calendar year, and to each proceeding relating to each electric
utility in such year, if the total sales of electric energy by
such utility for purposes other than resale exceeded 500 million
Kilowatt -hours during any calendar year beginning after December
31, 1975, and before the immediately preceding year; and
WHEREAS, pursuant to such criteria, the provisions of
said Act apply to the City of Anaheim Utility; and
WHEREAS, PURPA sets forth certain procedural requirments
for the determination of the appropriateness of certain rate making
standards of electric utilities; and
WHEREAS, such procedural requirements include public
notice and hearing with such determinations to be made in writing,
based on evidence presented, and available to the public; and
WHEREAS, PURPA provides that nonregulated utilities may
consider rate standards in any proceeding respecting the rates of
such electric utility; and
WHEREAS, the City Council of the City of Anaheim desires
to delegate the authority to conduct rate hearings pursuant to
PURPA to the Public Utilities Board of the City of Anaheim; and
WHEREAS, after such hearings, the City Council desires
the Public Utilities Board to submit all evidence presented along
with its determinations and recommendations to the City Council
for final action.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Public Utilities Board of the City of
Anaheim be, and it is hereby, delegated the authority to conduct
hearings pursuant to the Public Utility Regulatory Policies Act of
1978.
AND BE IT FURTHER RESOLVED that the Public Utilities
Board is directed to submit all evidence presented at such hear-
ings along with its determinations and recommendations to the City
Council.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 3rd ay April, 1979.
