RESOLUTION NO. 79R 171
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AINIAHEIM FINDING AND DETERMINING THAT
DALE C. WALTERS IS NOT INCAPACITATED WITHIN
THE I4EANING OF THE PUBLIC EMPLOYEES' RETIRE
MENT LAW FOR PERFORMANCE OF HIS DUTIES IN THE
POSITION OF POLICE OFFICER.
WHEREAS, the City of Anaheim is a contracting agency
of the Public Employees' Retirement System; and
WHEREAS, the Public Employees' Retirement Law
requires that a contracting agency determine whether an em-
ployee of such agency in employment in which he is classified
as a local safety member is disabled for purposes of the
Public Employees' Retirement Law and whether such disability
is "industrial" within the meaning of such Law; and
WHEREAS, an application for industrial disability
retirement of Dale C. Walters employed by the City of Anaheim
in the position of Police Officer has been filed with the
Public Employees' Retirment System; and
WHEREAS, the City Council of the City of Anaheim
has reviewed the medical and other evidence relevant to such
alleged disability including the recommendation of the City
of Anaheim Safety Employee Disability Retirement Evaluation
Committee.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Anaheim finds and determines, and it does here
by find and determine that Dale C. Walters is not incapacitated
within the meaning of the Public Employees' Retirement Law for
performance of his duties in the position of Police Officer.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized and directed to execute
all documents certifying said determination of the City Council
to the Public Employees' Retirement System.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 27th day of
March 19 79
