A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF CBRRO VISTA
STREET WEST OF LAKEVIEW AVENUE. (89-3A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 20th day of March, 1990, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, the City Council does determine that the
public convenience and necessity require the reservation and
exception of the easement(s) and right(s) of way hereinafter
specifically described.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of that portion
of Cerro Vista Street, more specifically described as follows:
That portion of Lot 9 of Tract 8949, in the City of
Anaheim, County of Orange, State of California, as
shown on a Map recorded in Book 581, pages 58, 59 and
40 of Miscellaneous Maps, records of said Orange
County, described as follows:
Beginning at the northeast corner of said Lot 9;
thence along the easterly line of said Lot, S 14° 10'
42" West, 20.00 feet to a point on a curve concave
Northerly having a radius of 110 feet; thence
Southwesterly and Westerly along said curve through a
central angle of 25° 50' 31" an arc distance of 49.61
feet to a beginning of a reverse curve concave
Southwesterly having a radius of 90 feet; thence
Northwesterly and Westerly along said curve through a
central angle of 25° 50' 31" an arc distance of 40.S9
feet to a point on the Southerly right of way line of
Cerro Vista Street, as shown on said Tract Map;
thence Northeasterly along said right o£ way line and
the Northerly line of said Lot 9 N 75° 49' 18" East,
134.25 feet to the point of beginning.
BE IT FUHTHER RESOLVED that the vacation authorized by
this resolution shall not be e£fective until a certified copy of
this resolution is recorded in the Of£ice of the Hecorder of
Orange County.
BE IT FURTHER HESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the O£fice o£ the Hecorder of
the County of Orange at such time as all of the following
conditions precedent to said vacation have been fulfilled:
1. Payment to City of $2,550.00.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 20th day of March, 1990.
