1979-429WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from 13\:A J.:USLLIE P=S, IC., owner, an I=AVISIOA, LJC., aL;eht, to ber:mit a bino parlor with a waiver of minirmum =Taber of parl:inz scaces on the real bro located in the City of Anaheim, County of Oraa,;0, State of California, and lasally described as: She Easterly 295 feet of the South 10.00 acres o the Soutneast Quarter of the Southwest Quarter of Section 34, •Townshic 3 South, Hane 10 '"-est, in the Rancho San Juan Cajon de Santa Ana, as shown on a mac recorded in book 51, cae. 7, :iiscellaneous naps, records of said Orane County; and ATTY-26 (Page 1 of 2 Pages) -1- RESOLUTION NO. 751 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1946 WHEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of which public hearing were duly given as re- quired by law and the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC79 -105 denyin; Conditional Use Permit No. 1946 and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consider- ation of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not im- pose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. That the owner of subject property shall pay to the City of Anaheim a fee, in an amount as determined by the City Council, for street lighting along Oran,ethoree Avenue. 2. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 3. That the pro binco parlor shah comply with all signing requirements of the 1114 'zoning. 4. That the owner of subject pro;?erty shall nay the differ- ence between the industrial and co nmerc i al traffic sic nal assess- ment fees (Ordinance No. 36966) in an amount as determined by the City Council, for that portion of the building used as a bingo parlor. parlor. 5. That the existing structure shall be brought u;) to the minimum stanaards of the City of Anaheim, including the uniform Building, Plumbing, Electrical, `riechanical and Fire Codes as adop- ted by the City of Anaheim. 6. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim !narked Exhibit Nos. 1 and 2. 7. That the per_nittee shall submit to the City Attorney's Office for approval a binding and le;.ally enforceable parkinp; agreement for use of at least one hundred (100) spaces of the Bryan Industrial Properties parking across the street from the subject property durin' the hours of bin o operation. o. That Conaition Dos. 1, 2, 4, 5, 6 and 7, above mentioned, shall be complied with within sixty (00) days from the approval of this Conditional Use Permit. 9. That this Conditional Use Permit -shall expire on February 1981. BE IT FURTHER ER E; SOLVED that the City Council hereby re- serves the right to revoke such Conditional use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim iiunicinal Code and regulations and the conditions therein.
