A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN AGREEMENT WITH ORANGE COUNTY WATER
DISTRICT FOR THE DELIVERY OF WATER FROM METRO
POLITAN WATER DISTRICT AND METROPOLITAN WATER
DISTRICT OF ORANGE COUNTY FOR USE BY THE CITY
OF ANAHEIM AND AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE SAME.
WHEREAS, the Metropolitan Water District (hereinafter
"MWD") and its member agency, Metropolitan Water District of Orange
County (hereinafter "MWDOC have established a program for the
period of March 1, 1979 to June 30, 1979, for the delivery of MWD
water to purveyors within its boundaries for use in lieu of ground
water at a reduced rate of ;37+.00 per acre foot for treated water
and :;53.00 per acre foot for untreated water; and
WHEREAS, the Orange County Water District (hereinafter
"OCWD is authorized to fix the terms and conditions of any con-
tract under which operators of water producing facilities within
its boundaries may agree to use water from an alternative nontri-
butary source in lieu of ground water and may pay from OCWD funds
a portion of the cost of said water from an alternate source to
encourage the purchase and use of the same in lieu of producing
ground water; and
WHEREAS, the Board of Directors of OCWD has found and
determined the persons and property within its boundaries are
directly or indirectly benefited by the replenishment which will
result from the use of said water in lieu of ground water; and
WHEREAS, the City of Anaheim desires to use water from
MWD and MWDOC in lieu of ground water and the parties hereto de-
sire to fix the terms and conditions for said use including pay-
ment by OCWD of a portion of the cost of such water; and
WHEREAS, an Agreement has been prepared, the terms and
conditions of which are satisfactory to the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of an Agreement
with the Orange County Water District for the delivery of water
from the Metropolitan Water District and the Metropolitan Water
District of Orange County for use by the City of Anaheim be, and
the same is hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be,
and they are hereby, authorized and directed to execute said Agree-
ment on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 1st day of May, 1979.
