A RESOLUTION OF THE CITY COUNICIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE EXE-
CUTION OF AN AGREEMENT WITH SOUTHERN PACIFIC
TRANSPORTATION COMPANY, GRANTING TO THE CITY
THE RIGHT TO DECONSTRUCT, MAINTAIN AND OPERATE
A MANHOLE ON THE PROPERTY OF SAID COMPANY AT
OR NEAR SOUTH ANAHEIM BOULEVARD, OPPOSITE
ENGINEER'S STATION 1285 +30, MILE POST 512.71.
WHEREAS, the Southern Pacific Transportation Company, a
corporation of the State of Delaware, has tendered to the City of
Anaheim an Indenture granting to the City of Anaheim, subject to
the reservations, covenants and conditions therein contained, the
right to reconstruct, maintain and operate a manhole beneath the
tracks and property of said Company at or near South Anaheim Boule-
vard, in the County of Orange, State of California, opposite
Engineer's Station 1285 +30, Mile Post 512.71, in the location shown
on the print of said Company's Los Angeles Division Drawing A -6775,
Sheet No. 1, revised December 19, 1978, attached to and made a part
of the Indenture above mentioned; and
WHEREAS, the City Council finds that said Indenture,
tendered to the City to be made and entered into between the par-
ties, would be for the benefit and in the best interest of the
City and should be approved.
JOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Indenture tendered to the City of
Anaheim by the Southern Pacific Transportation Company, a corpora-
tion of the State of Delaware, granting to the City, but subject
to the reservations, covenants and conditions therein contained,
the right to reconstruct, maintain and operate a manhole beneath
the tracks and property of said Company at or near South Anaheim
Boulevard, in the County of Orange, State of California, opposite
Engineer Station 1285 +30, Mile Post 512.71, as hereinabove more
particularly described, be, and the same is hereby, approved and
accepted.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said Indenture
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 1st day of May, 1979.
