1979-647RESOLUTION NO. 79R-647 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE ABATEMENT THEREOF. WHEREAS, the General Manager of the Utilities Department of the City of Anaheim has heretofore determined that the private water well located at 2540 Banyon Court, Anaheim, California, constitutes a public nuisance pursuant to Section 10.20.080 of the Anaheim Municipal Code; and WHEREAS, said real property is legally described as set forth on Exhibit "A" attached hereto and incorporated herein by this reference; and WHEREAS, on October 30, 1979, the City Council of the City of Anaheim held a duly noticed public hearing pursuant to Section 10.20.100 of the Anaheim Municipal Code and did hear and consider all relevant testimony and evidence offered by the landowner and all other interested persons relating to whether said private water well constitutes a public nuisance and should be abated. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. That the City Council does hereby find and determine that said private water well located on the herein described parcel of real property constitutes a public nuisance pursuant to Section 10.20.100 of the Anaheim Municipal Code. 2. That said public nuisance shall be abated by the backfilling and capping of said well in accordance with the Water Engineering Division's Standard Drawing No. 168, a copy of which is attached hereto, marked Exhibit "B," and incorporated herein by this reference. 3. That the General Manager of the Utilities Department is hereby directed to take any necessary action to protect the ground water or the health and safety of the public unless said nuisance is abated and corrected by the landowner in the manner hereinabove specified on or before November 1 5 1979. -1- THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 30th day of October, 1979.
