90-042 RESOLUTION NO. 90R-42
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ESTABLISHING SEWER FEES.
(ELM/CLEMENTINE SEWER ASSESSMENT AREA)
WHEREAS, Section 17.08.430 of the Anaheim Municipal Code,
adopted pursuant to the authority of Section 66483 of the
Government Code, requires subdividers or developers of property
within said sewage areas to pay certain sewer fees in such amounts
as established by resolution of the City Council; and
WHEREAS, the costs of constructing the sewer facilities
for said local sewage areas, whether actual or estimated have been
established by a sewer study conducted by the City of Anaheim
Public Works/Engineering Department; and
WHEREAS, said costs are based upon findings by the City
Council that subdivision and development of property within such
areas will require construction of the facilities, and that the
fees hereinafter set forth are fairly apportioned within such
areas either on the basis of benefits conferred on property
proposed for subdivision or on the need for such facilities
created by the proposed subdivision and development of other
property within such areas.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the foilowing fees be, and the same are
hereby, established pursuant to Section 17.08.430 of the Anaheim
Municipal Code for purposes of derraying the actual or estimated
costs of constructing facilities for the sewage areas hereinafter
specified.

THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 6th day of February ,
1990.
