COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 2015 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from TRIPLE H. LAND CO., owner; and JLP PARTNERSHIP, agent, to permit a commercial office complex with waiver of the minimum number of required parking spaces on property situated in the City of Anaheim, County of Orange, State of California, described as: THAT PORTION OF THE NORTHWEST ONE QUARTER OF SECTION 22, TOWNSHIP 4 SOUTH, RANGE 10 WEST, SAN BERNARDINO BASE AND MERIDIAN, CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA DESCRIBED AS FOLLOWS: BEGINNING AT THE INTERSECTION OF HARBOR BOULEVARD AND BALL ROAD, CITY OF ANAHEIM, SAID INTERSECTION ALSO BEING THE NORTH ONE- QUARTER CORNER OF SAID SECTION 22; THENCE ALONG THE CENTERLINE OF HARBOR BOULEVARD, ALSO BEING THE EAST LINE OF THE NORTHWEST ONE- QUARTER OF SAID SECTION 22, SOUTH 00 16' 16" EAST 59.90 FEET; THENCE AT RIGHT ANGLES, SOUTH 89° 43' 44" WEST, 30.00 FEET TO A LINE PARALLEL WITH AND DISTANT WESTERLY 30.00 FEET FROI4 SAID EAST LINE, TO THE TRUE POINT OF BEGINNING; THENCE NORTH 45 09' 58" WEST, 21.25 FEET TO A POINT IN A LINE PARALLEL WITH AND DISTANT SOUTHERLY 45.00 FEET MEASURED AT RIGHT ANGLES, FROM THE NORTH LINE OF SAID NORTHWEST ONE QUARTER, THENCE ALONG LAST SAID PARALLEL LINE SOUTH 89° 55' 36" WEST, 232.69 FEET TO THE INTERSECTION THEREOF WITH A CURVE CONCAVE NORTHERLY, HAVING A RADIUS OF 650.00 FEET; THENCE WESTERLY ALONG SAID CURVE FROM A TANGENT WHICH BEARS NORTH 82 57' 43" WEST, THROUGH AN ANGLE OF 07 08' 21" AN ARC DISTANCE OF 80.99 FEET TO A LINE PARALLEL WITH AND DISTANT SOUTHERLY 30.00 FEET FROM SAID NORTH LINE; THENCE NORTH 00 04' 24" WEST, 30.00 FEET TO SAID NORTH LINE; THENCE ALONG SAID NORTH LINE SOUTH 89° 55' 36" WEST, 295.27 FEET MORE OR LESS TO A POINT IN SAID NORTH LINE BEING THE EASTERLY TERMINUS OF THAT CERTAIN COURSE DE- SCRIBED AS HAVING A BEARING OF NORTH 89 55' 50" EAST, AND A LENGTH OF 141.77 FEET IN LANDS CONVEYED TO THE STATE OF CALIFORNIA, RECORDED AUGUST 8, 1950 IN BOOK 2052 PAGE 456 OF OFFICIAL RECORDS, ORANGE COUNTY; THENCE AT RIGHT ANGLES TO SAID NORTH LINE SOUTH 00 ATTY -26 (Page 1 of 2 Pages) WHEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of which public hearing were duly given as re- quired by law and the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC79 -175 granting Conditional Use Permit No. 2015 and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consider- ation of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular, area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not im- pose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said conditional use permit be, and the same is hereby, affirmed and that Conditional Use Permit No. 2015 be, and the same is hereby, granted permitting a commercial office complex on the hereinabove described property with a waiver of the following provision of the Anaheim Municipal Code: SECTION 18.06.060 Minimum number of parking spaces. (407 required; 387 proposed) ATTY -26 (Page 2 of 2 Pages) —2- 1. That the owner of subject property shall deed to the City of Anaheim a strip of land the width of which shall be deter- mined by the City Engineer along Harbor Boulevard and Ball Road for street widening purposes. 2. That all engineering requirements of the City of Anaheim along Harbor Boulevard and Ball Road including preparation of im- provement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facili- ties or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; that street lighting facilities along Harbor Boulevard and Bali Road shall be installed as required by the Office of Utilities General Manager, and in accordance with specifications on file in the Office of the Utilities General Manager; and /or that a bond, certificate of deposit, letter of credit, or cash, in a amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned require- ments prior to occupancy. 3. That a circulation plan showing left -hand turn access from Harbor Boulevard only and including raised medians in both Harbor Boulevard and Ball Road shall be submitted to and approved by the City Traffic Engineer; and shall then be constructed by the petitioner at the time this property is developed. 44. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Direc- tor of Public Works. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That subject property shall be served by underground utilities. 7. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 8. That the owner of subject property shall pay the traffic signal assessment fee (Ordinance No. ]896) in an amount determined by the City Council for commercial buildings prior to the issuance of a building permit. 9. That appropriate water assessment fees as determined by the Office of Utilities General Manager shall be paid to the City of Anaheim prior to the issuance of a building permit. 10. That the proposed office and restaurant complex shall comply with all signing requirements of the CR Zone. 04.'. 2 EAST, 30.00 FEET;. THENCE SOUTH 24 31' 33" WEST, 24.99 FEET TO A LINE PARALLEL WITH AND DISTANT 65.00 FEET NORTHEASTERLY, MEASURED AT RIGHT ANGLES, FROM THE NORTHEASTERLY LINE OF. THE 100.00 FOOT STRIP OF LAND DESCRIBED IN DEED TO THE WESTERN DEVELOPMENT COMPANY, RECORDED JUNE 12, 1876, IN BOOK 44 PAGE 1 496, OF DEEDS IN THE OFFICE OF THE RECORDER OF LOS ANGELES COUNTY, CALIFORNIA; THENCE ALONG LAST SAID PARALLEL LINE SOUTH 40 52' 20" EAST, 871.38 FEET MORE OR LESS TO THE NORTHWESTERLY TERMINUS OF THAT CERTAIN COURSE DESCRIBED AS HAVING A BEARING OF NORTH 40 52' 20" WEST AND A LENGTH OF 42.24 FEET IN LANDS CONVEYED TO THE STATE OF CALIFORNIA, RECORDED DECEMBER 24, 1954 IN BOOK 2905 PAGE 419 OF OFFICIAL RECORDS, ORANGE COUNTY; THENCE NORTH 03. 48' 44" EAST, .362.40 FEET; THENCE NORTH 11 02' 10" EAST, 204.16 FEET MORE OR LESS TO A POINT IN A LINE PARALLEL WITH AND 30.00 FEET DISTANT MEASURED AT RIGHT ANGLES FROM SAID EAST LINE OF SAID NORTHWEST ONE- QUARTER; THENCE ALONG LAST SAID PARAL- LEL LINE NORTH 00 16' 16" WEST, 90.46 FEET TO THE TRUE POINT OF BEGINNING; and 11. That this Conditional Use Permit is granted subject to the completion of Reclassification No. 66- 67 -61, now pending. 12. That the owner of subject property shall submit a letter requesting the termination of Variance No. 2434 and Conditional Use Permit Nos. 33 and 254 to the Planning Department. 13. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3 and 4; provided, however, that raised medians shall be constructed in Ball Road and Harbor Boulevard with one left turn access from Harbor Boulevard only. 14. That Condition Nos. 1, 2, 11 and 12, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission may grant. 15. That Condition Nos. 4, 6, 7 and 13, above mentioned, shall be complied with prior to final building and zoning inspec- tions. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions therein.
