A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM MAKING THE PROVISIONS OF SECTION
1094.6 OF THE CALIFORNIA CODE OF CIVIL PRO-
CEDURE APPLICABLE TO CERTAIN ADJUDICATORY
DECISIONS OF THE CITY OF ANAHEIM.
WHEREAS, Section 1094.6 of the California Code of Civil
Procedure provides that judicial review of any decision of a local
agency may be had by a petition for writ of mandate filed pursuant
to Section 1094.5 of the California Code of Civil Procedure if
such petition shall be filed not later than the ninetieth (90th)
day following the date on which the decision becomes final; and
WHEREAS, the term "decision" as used in said section
means adjudicatory administrative decision made, after hearing,
suspending, demoting, or dismissing an officer or employee, revok-
ing or denying an application for a permit or a license, or denying
an application for any retirement benefit or allowance; and
WHEREAS, said section further provides that it shall be
applicable in a public agency only if the governing board thereof
adopts an ordinance or resolution making said section applicable.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the provisions of Section 1094.6 of the
California Code of Civil Procedure are hereby made applicable to
the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 11th day of September, 1979.
