1979-510RESOLUTION NO. 79R -510 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE ACQUISITION OF A COMMUNICATION SYSTEM FROM NORTHERN TELECOM, INC. AT THE POLICE HEADQUARTERS WITH ANNEXES AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID AGREEMENT. WHEREAS, the City Council of the City of Anaheim has heretofore by resolution duly passed and adopted, approved and authorized the construction of the following public improvement, to wit: A communication system at Police Headquarters in accordance with the design, plans, profiles, drawings, and specifications; and WHEREAS, the City Council duly caused to be published a notice as required by law on the 17th and 24th days of May, 1979, inviting sealed proposals for the furnish- ing of all plant, labor, services, materials, and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accor- dance with said plans and specifications on file in the Office of the City Clerk of the City of Anaheim of said public improvement hereinabove mentioned and described, which notice specified that such sealed proposals would be received at the Office of the City Clerk up to the hour of 2:00 o'clock P.M., on the 7th day of June, 1979, and would be opened on said date at the hour of 2:00 o'clock P.M., in public, in the City Council Chamber in the City Hall, City of Anaheim, State of California, by the City Clerk and the City Engineer, and the result of said sealed proposals tabulated by the City Engineer and reported to the City Council at the sixth regular meeting for action thereon by the City Council; and WHEREAS, said notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prevailing rate of wages in the locality in which this type of labor is to be performed, for each craft or type of work- man or mechanic needed to execute the contract, and did state that the prevailing hourly wage scale so ascertained was on file in the Offices of the City Clerk and City Engineer; and WHEREAS, the City Engineer did thereupon duly tabulate all of the sealed proposals so received and did make a report to the City Council; and WHEREAS, the City Council of the City of Anaheim did, at its sixth regular meeting, held on the 17th day of July, 1979, at 1:30 o'clock P.M., find that the sealed proposal of the Contractor for furnishing of all plant, labor, services, -1- materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete the above described public works and improvement in strict accordance with the design, plans, profiles and specifications for said public works and improvement prepared by Com Consultants, and on file in the Office of the City Clerk of the City of Anaheim, was the low est responsible proposal submitted for the furnishing of said plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water and performing all work necessary for the construction of said public improvement as specified in the notice inviting sealed proposals; and WHEREAS, the City Council of the City of Anaheim did, on the 17th day of July, 1979, adopt Resolution No. 79R -419 accepting the sealed proposal of, and awarding to, the Contractor the contract to furnish all of said plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and perform all work necessary to construct and complete the hereinabove described public improvement or works in strict accordance with the design, plans, profiles and specifications for said public works and improvement prepared by Com Consultants, and on file in the Office of the City Clerk of the City of Anaheim, for the construction and completion of said public works and improvement above described, in accordance with the notice inviting sealed proposals, the plans and specifications, the instructions to bidders, and in accordance with the written contract to be made and entered into by and between the City and said Contractor, in the form, a copy of which is on file in the Office of the City Clerk of the City of Anaheim. WHEREAS, an Agreement this day has been submitted pursuant to the aforesaid public bidding, the terms and conditions of which are satisfactory to the City Council of the City of Anaheim; and WHEREAS, it is in the best interests of the City of Anaheim to enter into said Agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that that certain Agreement between the City and Northern Telecom, Inc. to install a communica- tion system at the police building be, and the same is hereby, approved. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby authorized to execute said Agreement and annexes for and on behalf of the City of Anaheim. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this4th day of September, 1979.
