1979-490RESOLUTION NO. 79R -490 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 3105. WHEREAS, after a request for variance by TEXACO- ANAHEIM HILLS, INC., owner; LIND HILLERUD, INC., agent, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 3105 was denied covering the following described property: That portion of the land allotted to Juan Pablo Peralta, Maria Jesus Peralta de Copas, and Maria de Alverez, as described in the Final Decree of Partition of the Rancho Santiago de Santa Ana, which was entered September 12, 1868 in book "E page 410 of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California, more particularly shown as Parcel 3 on a map filed in book 127, pages 9, 10, 11 and 12 of Parcel Maps, records of Orange County, California, being a subdivided as Tract No. 8117; and WHEREAS, thereafter, within time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing no- ticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surround ings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of priv- ileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby, granted permitting the waiver of maximum structural height to establish a ninety -nine (99) unit, RM- 3000(SC) condominium subdivision on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.31.062.012 Maximum structural height within 150 feet of single- family resi- dential zoning. (One story permitted; two stories proposed) That said variance be granted subject to the following conditions: -1- 1. That this variance is granted subject to the completion of Reclassification No. 79 -80 -5, now pending. 2. That prior to the issuance of a building permit, final specific plans, including plot plans, floor plans and elevations, shall be submitted to and approved by the Planning Commission. BE IT FURTHER RESOLVED that the City Council hereby re- serves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
