90-027 RESOLUTION NO. 90R-27
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM DENYING VARIANCB NO.
WHEREAS, after a request for variance by BALL-LEMON
CENTER, INC., 9801 Wilshire Boulevard, Beverly Hill, California,
owner and Charles Sedgh, agent, was received, a public hearing
before the Zoning Administrator of the City of Anaheim was held
upon due and proper notice, a result of which Variance No. 400S
was granted covering the following described property:
Parcel 1:
That portion of Lot 26 of "Anaheim Extension", in the
City of Anaheim,County of Orange, State of California,
as shown on a map of survey made by William Hamel and
filed for record in the Office of the County Recorder of
Los Angeles County, described as follows:
Beginning at the southwest corner of said Lot 26, said
point being the intersection of the centerline of Lemon
Street with the centerline of Ball Road, as shown on
said survey; thence North 89 degrees SS minutes iS
seconds East ~280.00 feet along the South line of said
Lot 26 to the Southwesterly corner of the land conveyed
to Sarah Bennett, a widow, by Deed recorded February 16,
19S5 in book 2454 page S7, Official Records; thence
Northerly, along the Westerly line of said land to a
line parallel with and 120 feet Southwesterly of the
North line of the land conveyed to R. L. Keith and wife
by Deed recorded November 18, 1946 in book 14S6 page
SSS, Official Records; thence South 74 degrees 20
minutes 1S seconds West 277.82 feet along said parallel
line to a point in the West line of said Lot 26, being
the centerline of Lemon Street; thence South 15 degrees
25 minutes 45 seconds East 211.89 feet along the West
line to the point of beginning.
Excepting therefrom the Northeasterly 115.50 feet
thereof, measured along the Northwesterly line of said
land.
Also excepting from the reminder thereof, the
Northwesterly 20.00 feet thereof; and
WHEREAS, the City Council does further find, after
careful consideration of the action of the Zoning
Administrator and all evidence and reports offered at said
public hearing before the City Council regarding said
requested waiver(s), that all of the conditions set forth in
Section 18.06.080 of the Anaheim Municipal Code are not
present, and that said waiver(s) of off-street parking
requirements should be denied, for the following reasons:

1. That the variance(s) will cause an increase in
traffic congestion in the immediate vicinity and adversely
affect adjoining land uses; and
2. That the granting of the variance(s) will be
detrimental to the peace, health, safety or general welfare
of the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City o£ Anaheim that said Variance be, and the same is
hereby, denied.
BE IT FURTHER RESOLVED that the time within which
reheatings must be sought is governed by the provisions of
Section 1.12.100 o£ the Anaheim Municipal Code and the time
within which judicial review of {inal decisions must be
sought is governed by Section 1094.6 of the Code of Civil
Procedure and Anaheim City Council Resolution No. 79R-524.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 9th day o£
