A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT
CERTAIN WORK IS OF URGENT NECESSITY AND
APPROVING AN AWARD OF CONTRACT TO NICK DIDOVIC
CONSTRUCTION COMPANY WITHOUT ADVERTISING FOR
BIDS (WOODSBORO AVENUE AND NORTHFIELD AVENUE
STORM DRAIN CLEANING AND MANHOLE CONSTRUCTION).
WHEREAS, Anaheim City Charter Section 1211 provides
that contracts on public works may be let without advertising
for bids if such work shall be deemed by the City Council to
be of urgent necessity for the preservation of life, health
or property; and
WHEREAS, due to substantial grading activity in the
City of Yorba Linda, large quantities of silt and mud have
collected in the City of Anaheim portion of the storm drain
system located at Woodsboro Avenue and Northfield Avenue; and
WHEREAS, such collection of silt and mud could cause
water in the storm drain to back up which could result in
Property damage to both streets and private property; and
WHEREAS, the City Council has been advised by the
City Engineer that such collection of silt and mud in said
storm drain has created an emergency calling for immediate
correction; and
WHEREAS, the City Council finds and determines that
such corrective work consisting of cleaning and manhole con-
struction is of urgent necessity for the preservation of health
and property; and
WHEREAS, informal bids have been requested from four
contractors and the three bids submitted have been analyzed by
the City Engineer; and
WHEREAS, the Nick Didovic Construction Company has
submitted the lowest bid for such work; and
WHEREAS, an agreement has been prepared, the terms
and conditions of which are acceptable to the City Council
of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that:
1. Immediate corrective work consisting of storm
drain cleaning and manhole construction at or near Woodsboro
Avenue and Northfield Avenue in the City of Anaheim is of
urgent necessity for the preservation of health and property;
and
2. A contract for such work is hereby awarded to
Nick Didovic Construction Company.
The terms and conditions of an Agreement between
the City of Anaheim and Nick Didovic Construction Company
are hereby approved and accepted.
4. The Mayor and City Clerk are hereby authorized
to execute said Agreement on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim thisl8th day of
