1967-588 ~."",- - RESOLUTION NO. 67R-588 ,/~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND OETERMINING THAT TITLE 18 OF THE ANAHEIM !MUNICIPAL CODE RELATING TO ZONING SHOU~D BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning cqmmission of the City of Anaheim did hold a public hearing in R~classification Proceed- ings No. 67-68-26 to consider an amendment to Title l8 of the Anaheim Municipal code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did dul,y adopt a resolution containing a report of its findings, a su~~ary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 24th day of October , 19 67 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title l8 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it. is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title. 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. - NOW, THEREFORE, BE IT RESOLVED by the City council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the city of Anaheim, County of Orange, State of California, to wit: -1- 67-68-26 - -or - - .,..-. All tnat real property in the City of Anaheim, County of Orange, State of California, being that portion of the Southeast quarter of Section 8, Township 4 South, Range 10 West in the Rancho Los Coyotes, as said Section is shmm on the map recorded in BOQk 51, Page 10 of rvliscel- laneous Maps, records of said County, described as follows: Beginning at the point on the Westerly line of Crescent Way, 60 feet wide, as described in Parcel 2 of the deed to the City of Anaheim, recorded in Book 4089, Page 397 of Official Records, records of said County, distant North 00 08' 37" West, along said Westerly line, and the South- erly prolongation thereof, 609.33 feet from the Southerly line of said Section 8; thence North 890 30' 39" West parallel with the Southerly line of said Section 8 a dis- tance of 804.28 feet to the Easterly line of Muller Drive, 60 feet wiae as described in Parcell of said deed; thence, along said Easterly line, South 00 02' 24u East 544.54 feet, more or less, to the beginning of a tangent curve concave Northeasterly and having a radius of 25.00 feet, said curve being tangent also to a line parallel with said Southerly line of Section 8 and distant Northerly 40.00 feet therefrom, measured at right angles; thence Southeast- erly, along said curve, through a central angle of 890 28' IS", a distance of 39.04 feet to said parallel line; thence South 890 30' 39" East, along said parallel line, 755.26 feet to a point on the Westerly line of said Crescent Way, said point being- the Southwesterly -terminus of the 25.00 foot radius curve described in said Parcel 2 as being con- cave Northwesterly, having a delta of 900 37' 37", and a length of 39.54 feet; thence, along said Westerly line, along the arc of said curve Northeasterly, through a cen- tral angle of 900 37' 58", a distance of 39.55 feet; thence tangent to said curve, and continuing along said Westerly line, North 00 08' 37" West 544.04 feet to the point of beginning. Containing an area of 10.512 acres, more or less. be excluded from M-L, LIGHT INDUSTRIAL ZONE, and incorporated in C-2, GENERAL CO~~RCIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 32 feet in width, from the centerline of the street, along ~1uller Street and Crescent Way, including a l5-foot radius corner return, for street widening purposes. 2. (a) That all engineering requirements of the City of ffilaheim along Lincoln Avenue, including preparation of improvement plans and installation of all improvements, sucn as curDS and gutters, sidewalks, street grading and paving, drainage faciliti2s, or other appurtenant work shall be complied wib-l as nXiuired by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an anount and for;,1 satisfactory to the City of ffilaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue, Auller Street and Crescent Way, for street light-- ing purposes. r, --.t:,.- ~ --. 4. That tile owner of sUDject property shall pay to the City of lillaheim the sum of 15~ per front foot along Lincoln Avenue, Muller Stree.t and Crescent Way, for tree planting purposes. ,,,-. 5. That a Parcel Map to record tne approved division of subject propertj:" shall be submitted to the City of Anaheim for approval, and then recorded in the Office of the Orange County Recorder. 6. That sidewalks shall be installed along Muller Street and Crescent Way, as required by the City Engineer and in accordance with standard pla~s and specifications on file in the Office of the City Engineer, prior to final building and zoning inspections. 7. That trash storage areas shall be provided in accordance with approveu plans 011 file in the Office of the Director of Public Works and Superintend~nt of Streets, prior to final building and zoning inspe~tions. 8. That all air conditioning facilities shall be properly shielded from view from abutting streets prior to final building and zoning inspections. 9. That the lighting of the parking areas shall be of a downlighting type, directed away from adjacent residential properties, and that said downlighting shall be installed prior to final building and zoning inspections. 10. That subject property shall be developed substantially in accordance with site development standards of the C-l, General Con~ercial Zone. 11. That Conditions Nos. 1, 2(b) i 3, 4 and 5 above-mentioned shall be complied with within a period of 180 days from date nereof, or such further time as the City Council may grant. BE IT FUR'rIiER RESOLVED .tnat the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an Ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
