1967-586 - RESOLUTION NO. 67R~586 ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM iMUNICIPAL CODE RELATING TO ZONING SHOU~D BE AMENDED AND THAT THE BOUNDARIES OF CEIRTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Cqrnmission of the City of Anaheim dtd hQld a public hearing in Relclassification Proceed- ings No. 7-6~-24 to conisider an amendment to Title l8 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, an~ at said hearing did receive evidence and reports from pers~s interested therein and from its staff; and WHEREAS, wi thin a period of fiorty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, asurn.~ary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and reco~ndation of the City Planning Commission the City Council did fix the 24th day of October , 19 67 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title l8 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it. is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and plac!e fixed for said public hearing the City Council did hold and conduct such public hearing and.did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title. 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -l- 67-68-24 .....- m; _. PARCEL l: ,...- A portion of the South Half of the Northeast Quarter, North- east Quarter, of Section l3, Townsh~p 4 South, Range II West, S.B.B. & M., in the City of Anaheim, County of Orange, State of California, described as follows: Beginning at the southeast corner of the Northeast Quarter, Northeast Quarter, of said Sectionl3, said point also being the center line intersection of Broadway and Magnolia Avenue; thence South 890 36' 00" West along the southerly line of said Northeast Quarter, Northeast Quarter of Section l3, said line also being the center line of Broadway 253.00 feet; thence North 00 ll' 50" West 45.00 'feet to the True Point of Beginning of this description; thence continuing North 00 ll' 50" West 288.l7 feet; thence North ,890 37' 24" East 50.00 feet; thence South 00 ll' 50" East 288.l5 feet; thence South 890 36' 00" West parallel with said southerly line 50.00 feet to the True Point of Beginning. PARCEL 2: A portion of the South Half of the Northeast Quarter, North- east Quarter, Section l3, Township 4 South, Range II West, S.B.B. & M., in the City of Anaheim, County of Orange, State of California, described as follows: Beginning at the southeast corner of the Northeast Quarter, Northeast Quarter of Section l3, said point being the center line intersection of Broadway and Magnolia Avenue, thence South 890 36' 0011 West along the southerly line of said North- east Quarter, of the Northeast Quarter of Section l3, said line also being the center line of Broadway 664.13 feet; thence North 00 ll' 5011 West 45.00 feet to the southeast corner of Tract No. 2938 as shown on a map recorded in Book ll9, Pages 28 and 29 of Miscellaneous Maps, records of said Orange County, said point also being the True Point of Beginning of this description; thence continuing North 00 ll' 5011 West along the easterly line of said Tract No. 2938, 288.34 feet; thence North 890 37' 24" East 411.l3 feet; thence South 00 ll' 5011 East parallel with said easterly line of said Tract No 2938, 288.17 feet; thence South 890 36' 00" West parallel with said southerly line 4ll.13 feet to the True Point of Beginning. be excluded from C-l, GENERAL COMMERCIAL ZONE and R-A, AGRICUL- TURAL ZONE, and incorporated in R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, upon the following conditions: l. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Broadway for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim along Broadway, including preparation of improvement plans and installation of all improve- ments, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or - -2- ~ ..... ~ - other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Enginee~; and (b) that a bond in an amount and form satisfaqtory to the City of Anaheim shall be posted with the City to guarantee the instal- lation of said engineering requirements. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Broadway, for street lighting purposes. That the owners of subject property shall pay to the City of Anaheim the sum of l5~ per front foot, along Broadway, for tree planting purposes. That a Parcel Map to record the approved division of subject property shall be submitted to the City of Anaheim for approval, and then recorded in the Office of the Orange County Recorder. 4. 5. 6. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 7. That Conditions Nos. l, 2(b), 3, 4 and 5 above.- mentioned shall be complied with within a period of l80 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title l8 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
