RESOLUTION NO. 67R- 580

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING AND DIRECTING
THE MAYOR AND CITY CLERK TO EXECUTE AN
AGREEMENT DATED OCTOBER 24" 1967, BETWEEN
THE CITY oF ANAHEIM AND THE ORANGE COUtlTTY
WATER DISTRICT..

WHEREAS, the City of AnaheUi is acquiring, through
eminent domain proceeding~ (Superior Court Case No. l2738l),
the water rights of the Anaheim Union Water COIDpany in the Santa
Ana River, together with certain lands and appurtenances as more
fully set forth in the Final Order of Condemnation in said case;
and
WHEREAS, the City'council finds that it is in the best
interests of the. c~ty of Anaheim to s~ll to the Orange County
wa~.rDistrict ~e~water~ri~hts.,and a. portion of ~facilities
condemned, cons1st1ng of the CaJon Canal, the easeme~ts and
rights of way over the Shorb property, the distribution facili-
ties, the water and water rights (described respectively in said
Final Order of Condemnation as, Parcels 1,<< 3 ,~9and lJ)), together
with'thefight to use Parcels 4, 6, 7 and 8 as described in said
Final Order, subject to the obligation of said Orange County
Water District to fill the irrigation requirements of the present
a9ricultural. . shareholders of Anaheim Union Water Company as set
forth in said Final Order; and
WHEREAS, the Orange County Water District has offered
to purchase the foregoing for a total sum of $2,881,ll7.00, which
said sum includes a proportional share of the City of Anaheim's
expenses in connection with said eminent domain litigation; and
WHEREAS, said Agreement contemplates that the City of
Anaheim will execute a Grant Deed, a Bill of Sale and an Easement
Deed to carry out the terms of said Agreement; and
WHEREAS, said Agreement has been reviewed by, and
approved as to form by the City Attorney.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it authorize and direct, and it does
hereby authorize and direct the Mayor and City Clerk to execute
on behalf of the City of Anaheim that certain Agreement dated
October 24, 1967, between the City of Anaheim and the Orange
County Water District.
THE FOREGOING RESOLUTION is approved and signed by
me this 24th day of October, 1967.
