1967-578 - illiSOLUTION NO. 67R-578 ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEHl APPROVING Ai'\JD AOTHORI ZING THE EXECUTION OF AN AGP~E~lliNT SETWEEN THE CITIES OF ANAHEIM AND GARDEt; GROVE, PROVIDING FOR THE JOINT RECONSTRUCTION OF THE WEST STREET STORJ:.l DRAIN NORTH OF ORAi'JGEWOOD AVENUE. vVHEREAS, West Street, Nortn of Orange\vood Avenue lies partly within the City of Garden Grove and partly within the City of Anaheim; and WHEREAS, West Street is part of the Select System of streets in both the cities of Anaheim and Garden Grove; and ':J1-lEREAS, the City of Garden Grove intends to recon- struct and widen that part of West Street lying within said City; and viliEREAS, the City of Garden Grove intends to reconstruct the storm drain lying in West Street south of Orangewood Avenue; and WHEEEAS, the City of Anaheim desires that the West Street storm drain lying north of Orangewood Avenue be recon- structed as part of the project proposed by the City of Garden Grove; dnd NHEREAS, Section 136.5 of the Streets and Highways Code of the State of California provides that when funds apportioned pursuant to Sec. 186.1 are utilized on joint or cooperative projects between cities, the agreement authorizing the use of such funds snall designate the agencies which shall provide the match- ing funds required by Sec. 186.5. viliEREAS, a form of agreement, providing for the recon- struction of saici storm drain, has this day been submitted to the City Council to be made and entered into between the parties, the terms and conditions of which the City Council finds to be satisfactory. aO'i'{, THEREFORE, BE IT RESOLVED by the City Council of the City of p,naheim that the agreement this day submitted to the City Council to be made and entered into between the parties, providing for the reconstruction of said storm drain in West Street, the terms and conditions of which read as follows: 1. Garden Grove is designated as agent for Anaheim for the purpose of contracting for and constructing the storm drain imprOVeITlents described in this agreement and is authorized by Anaheim to perform all acts necessary or required in order to construct the im- provements in accordance with the approved plans and specifications. It is further agreed that after construction bids for the project have been opened and reviewed Garden Grove may, at its discretion, aware a contract to the lowest responsible bidder as determined by the Garden Grove City Council, pro- viding t.ne total construction cost of the improve- ments for Ananeim does not exceed $70,000.00. Garden Grove agrees to ?repare plans, specifications, cost estimates and to furnish construction engineer- ing for the total West Street project covered by .tilis agreer.lent. 3. Garden Grove agrees that said plans and specifications shall meet tile approval of Anaheim, County of Orange and California Division of Highways and that Anaheim shall approve and sign t.11e plans prior to commencement of construction by GardeD Grove. 11. Anaheinl agrees to reLnburse Garden Grove its propor- tionate share of the design and construction engineer- ing costs based on the same proportion used in dis- tributing the construction costs. 5. It is mutually agreea 'chat Garden Grove will construct, at its cost, tne roadway on West Street as shown on Zxhibit A under the construction contract herein con-- templated. It is further agreed that ffi1aheim will, at a future date, and at its cost, complete the West Street roauway north of Orangewood Avenue. 11. Garden Grove agrees to prepare the final construction report witnin 90 Clays after completion and acceptance of the construction contract in compliance with re- quirements of the State Division of Highways and Orange County Road Department. Within 30 days after comple-- tioD of the final construction report, Garden Grove agrees to reimburse Anaheim any unused funds deposited by p...naheim and witllin said 30 day period Anaheim -2- - - -, /'- agrees to proviQc sufficient additional funds as may be required to effectuate the final proportionate project costs to each City as shown in the final con- struction report. 12. r.t is understoou that Garden Grove has the right to rnake routine change orders .with the Contractor on the work for which it is acting as agent for Anaheim; provided, nowever, no change involving the expenditure of an ~aount in excess on one thousand dollars ($1,000.00) may be made without first having written approval of Anaheim. be, and the same is hereby approved.
