1979-703RESOLUTION NO. 79R -70j A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 3119. WHEREAS, after a request for variance by ROBERT A. MAH AND ADELINE C. L. YEN MAH dba PACIFIC TERRACE APARTMENTS, was re- ceived, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 3119 was denied covering the following described property: That portion of allotments in Decree of Partition of the Rancho Canon de Santa Ana, recorded in Case No. 1978 of the 17th Judicial District Court of Califor- nia, a certified copy of which was recorded February 8, 1874 in book 28, page 158 of Deeds in the office of the County Recorder of Los Angeles County, Cali- fornia, described as follows: Beginning at the North- easterly corner of the land described in the deed to the State of California recorded October 30, 1956 in book 3693, page 378, Official Records in the office of the County Recorder of said Orange County, said point being also a point on the Southerly line of 100.00 wide strip of land, as conveyed to the River- side, Santa Ana and Los Angeles Railway Co., by deed recorded July 7, 1886 in book 164, page 508 of Deeds, records of Los Angeles County, California, said 100.00 foot strip being now vested in the Atchison, Topeka and Santa Fe Railway Company, corporation; thence along said Southerly line North 88° 31' 41" East 787.52 feet to the beginning of a tangent curve con- cave to the North having a radius of 5779.65 feet; thence Easterly along said curve through a central angle of 0° 19' 02" a distance of 32.00 feet to a point, a radial to said point bears South 1° 47' 21" East, said point being the true point of beginning; thence S 1° 23' 66" West 1202.21 feet to a point on a non tangent curve concave to the North having a radius of 1445.00 feet, a radial to said point bears South 5° 29' 18" West; thence Easterly along said curve through a central angle of 23° 31' 15" a distance of 593.20 feet to a point on a tangent line, said line being the Northerly line of the line described in a deed to Orange County Flood Control District, recorded Febru- ary 6, 1939 in book 980, page 303, Official Records of said county; thence along said Northerly line North 71 58' 03" East 838.18 feet to the beginning to a tangent curve concave Northwesterly having a radius of 1600.00 feet; thence along said curve through a central angle of 13° 53' 03" a distance of 527.35 feet to a point on a non tangent line, a radial to said point bears South 36° 55' 00" East, said point being on the Easterly line of the land conveyed to Joe Leung Young, per Deed re- corded September 13, 1955 in book 3206, page 194, -1- WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are no special circumstances applicable to the property which do not apply to other property in the same vicinity and zone. 2. That strict application of the zoning code does not de- prive the property of privileges enjoyed by other property in the same and zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that said Variance be, and the same is hereby, denied. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 4th day of December, 1979. ATTEST: JLW:fm Official Records of said county; thence along said East- erly line the following two courses: North 1 30' 56" East 918.56 feet to Station 11 of second class land, allotted to Ynez Yorba De Cota in partition of the Rancho Canon De Santa Ana, a certified copy of which Decree was recorded February 8, 1874 in book 28, page 158 of Deeds, records of Los Angeles County, Califor- nia; and North 0° 28' 56" East 81.05 feet to a point on the aforesaid Southerly line of a strip of land 100.00 feet wide, being a point on a non tangent curve concave Northerly having a radius of 5779.65 feet, a radial to said point bears South 20° 30' 23" East; thence Westerly along said curve through a central angle of 18° 43' 02" a distance of 1888.08 feet to the true point of beginning.
