1979-683RESOLUTION NO. 79R -683 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 3114. WHEREAS, after a request for variance by ST. MARK'S UNITED METHODIST CHURCH, owner; WALTER FORSYTHE, agent, was received, a pub- lic hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 3114 was granted covering the following described property: The south 160 feet of the east one -half of the West one half of the Northeast quarter of the Southeast Quarter of Section 15 township 4 South Range 11 West in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in book 51, page 11 of Miscellaneous Maps, in the office of the County recorder of said County, lying Northerly of the West- erly prolongation of the center line of Mungall Drive as shown on a map of Tract No. 3591, as per map recorded in book 133 pages 18 and 19 of Miscellaneous Maps, in the office of the County recorder of said County. Excepting the West 100 feet thereof; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the prop- erty, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifi- cation in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privi- leges enjoyed by other property under identical zoning classification in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City ofd Anaheim, that a conditional zoning variance be, and the same is hereby, granted permitting the construction of an 18 -unit apartment complex on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.34.062.012 Maximum building height. (1 story permitted within 150 feet of agricultural zoning; 2 stories proposed) SECTION 18.34.066.062 Permitted vehicular access. (alley access only permitted; alley and street access proposed) That said variance be granted subject to the following conditions: 1. That this Variance is granted subject to the completion of Reclassification No. 79- 80 -11, now pending. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2 and 3. BE IT FURTHER RESOLVED that the City Council hereby re- serves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
