90-002 RESOLUTION NO. 90R-2
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE DESTRUCTION, BY
ERASURE OR OTHERWISE, OF RECORDED TELEPHONE
AND RADIO COMMUNICATIONS MAINTAINED BY A CITY
DEPARTMENT WHICH RECORDINGS ARE MORE THAN 100
DAYS OLD.
WHEREAS, Section 34090.6 of the Government Code of the
State of California authorizes the destruction, by erasure or
otherwise, of recordings of telephone and radio communications
maintained by any city department provided (i) said recordings
are more than 100 days old, (if) such destruction is approved by
the City Council with the written consent of the City Attorney,
and (iii) such recordings are not evidence in any claim filed or
any pending litigation; and
WHEREAS, the hereinafter described recordings of
telephone and radio communications are being maintained by a
department head of the City of Anaheim (hereinafter "custodian of
records") and such recordings are more than 100 days old; and
WHEREAS, the custodian of records has determined said
recordings are not evidence in any claim filed or any pending
litigation; and
WHEREAS, said recordings are no longer needed or
required by the City; and
WHEREAS, the City Attorney of the City of Anaheim does
by the approval o£ this resolution hereby give written consent to
the destruction, by erasure or otherwise, of the hereinafter
described recordings.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the custodian of records be, and he or
she is hereby authorized to destroy, by erasure or otherwise, the
recordings of telephone or radio communications as more
particularly described on Exhibit "A" attached hereto and
incorporated herein by this reference.
BE IT FURTHER RESOLVED that upon destruction of the
foregoing records, a certificate of destruction shall be executed
by the custodian of records and the original thereof filed in the
Office of the City Clerk together with a copy of this resolution.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 2rid day of January, 1990
