1967-228RESOLUTION NO. 67R- 228 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AND AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH ORANGE COUNTY FOOD SERVICE WITH REFERENCE TO THE INSTALLATION OF A RAINWATER VALVE TO PREVENT STORM WATERS ENTERING AN UNCOVERED DRAIN. WHEREAS, Orange County Food Service is desirous of establishing a drain opening into the sewer system of the City of Anaheim, which drain will be located on an area devoted to the parking of Orange County Food Service vehicles, said area on which said drain is to be located being commonly known as 3051 Miraloma Avenue, Anaheim, California; and WHEREAS, Orange County Food Service is desirous of utilizing said drain proposed to be constructed at the same grade as the surface of the parking area for the purpose of permitting water to drain from Orange County Food Service vehicles; and WHEREAS, Orange County Food Service is desirous of avoiding the necessity of providing a roof or cover over the parking area to be devoted to the parking of its vehicles; and WHEREAS, the Uniform Plumbing Code, 1964 Edition, has been adopted by the City and Section 1102(b) of said Plumbing Code reads as follows: "No rain, surface or subsurface water shall be connected to or discharge into any drainage system, unless first approved by the Administrative Authority." AND WHEREAS, pursuant to this aforementioned section of the Plumbing Code, the City would normally require that a drain such as that proposed by said Food Service be raised above the grade of the parking area and be completely covered; and WHEREAS, in lieu of completely covering said drain or completely covering the aforementioned parking area of Orange County Food Service, and in order to prevent rain water from entering the sewer system and placing an undue burden upon the capacity of said sewer system at such time as rain or storm waters enter the uncovered drain, said Food Service has offered to install on such open drain a certain valve known as a T.M. Rainwater Valve; and WHEREAS, the City has investigated the operation of such a valve and is agreeable that such a valve be installed on said open drain in lieu of the requirement that the open drain and parking area be completely roofed or covered; and WHEREAS, the City is agreeable to the installation of the aforementioned valve in lieu of covering said drain only on certain conditions; and WHEREAS, the City and Orange County Food Service desire to enter into an agreement specifying the conditions subject to which said Rainwater Valve may be installed; and WHEREAS, a form of agreement, dated April 6, 1967, has this day been submitted to the City Council to be made and entered into between the parties, the terms and conditions of which the City Council finds to be satisfactory, and that said agreement should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the agreement, dated April 6, 1967, this day submitted to the City Council to be made and entered into between the parties, providing for the installation of a T. M. Rainwater Valve to prevent rain or storm waters enter- ing an uncovered drain located on an area devoted to parking of Orange County Food Service vehicles at 3051 Miraloma Avenue, Anaheim, upon the terms and conditions set forth in said agree- ment, be, and the same is hereby approved. be, and for and BE IT FURTHER RESOLVED that the Mayor and they are hereby authorized to execute said on behalf of the City of Anaheim.
