1967-203RESOLUTION NO. 67R -203 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 925 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from J. E. PRUETT, 422 West Hampshire Street, Anaheim, California, to permit office use of the two residential structures situated on the property hereinafter described, and permitting waivers of the following Anaheim Municipal Code requirements on said property: (a) Minimum number of parking spaces and location of parking area (Sections 18.38.050(4) -A -3) and 18.38.040(3)-D); (b) Minimum landscaping (Section 18.38.040(3) -D); (c) Six -foot masonry wall on the zone boundary line abutting any residential zone (Section 18.38.050(b)); (d) Minimum site area (Section 18.38.050(1) -A); Said property is described as follows: All that real property situated in the City of Anaheim, County of Orange, State of California, described as: Lots 1 and 2 of Tract No. 1516, as per map thereof recorded in Book 44, Pages 37 and 38 of Miscel- laneous Maps, Records of Orange County, California. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on February 27 19 67 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC67 -44 denying Conditional Use Permit No. 925 and -1- WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting °the action of the City Planning Commission in denying_ said Conditional Use Permit and said appeal was set for public hearing on Aord.l 9 19 67 at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the ti e and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the reco.%endations of the City Planning Commission and all evidence and reports offered at said hearing, theto 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Ariethei Munnic ip '.1 Code. The roposed use will n adversely affect the adjoining land use and the growth and develop- ment of the tree in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and genera1 we1f. rt. 4. The traffic generated by the proposed use will not iaspo:_;e an undue burden upon the streets -nd highways designed nd i proved to carry the traffic in the -reap 5. The gr.. f the Condition 1 Use Permit under the conditions imposed will not be detrimental to the peace, he lth, safety and general welfare of the citizens of the City of Anaheim. IOW, THEREFORE, BE IT RESOLW; by the City Council of the City of Anahei.', that the action of the City Planning Commis- sion denying said Condition ;-.1 Use Permit be, and the same is hereby disapproved nd th <l:t Conditional Use Permit Ho. 925 be, and the s,; me is hereby, granted permitting office= of the two residential structures situated on the property hereinbefore described, and permitting waivers of the following Anaheim Municipal Code requirements on said property, subject to the conditions hereinafter set forth: (a4 A waiver of the minimum number of parking spaces and location of parking area (Sections 18.38.050(4) -A -3) and 18.38.040(3) -D); That said conditional use permit is granted subject to the following conditions: ATTEST (b) A waiver of the minimum landscaping (Section 18.38.040(3) -D); (c) A waiver of the six -foot masonry wall on the zone boundary line abutting any residential zone (Section 18.38.050(b)); (d) A waiver of the minimum site area (Section 18.38.050(1) -A). 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Harbor Boulevard, including a 15 -foot radius corner return, for street widening purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Harbor Boulevard and Hampshire Street, for street lighting purposes. 3. That the owner of subject property shall pay to the City of Anaheim the sum of 15 per front foot along Hampshire Street, for tree planting purposes. 4. That trash storage areas shall be provided in accord- ance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building and zoning inspections. 5. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1, 2, 3, 4 and 5. 6. That this conditional use permit is granted subject to the completion of Reclassification Proceedings No. 65 -66 -63 now pending for C -0, Commercial Office Zoning. 7. That a temporary waiver is hereby granted of the walls on the east and south boundaries of subject property, as required in the C -0 Zone, until such time as deemed necessary by the City. 8. That Conditions Nos. 1, 2 and 3 above mentioned shall be complied with prior to the issuance of a building permit, or within a period of 180 days from date hereof, whichever occurs first, or such further time as the City Council may grant.
