1967-186WHEREAS, heretofore, by its resolution duly adopted
and passed on the 14th day of April, 1964, the City of Anaheim
authorized and directed the institution of condemnation proceed-
ings which resulted in the commencement of Orange County Superior
Court Case No. 123219, being entitled "City of Anaheim vs.
George A. Michel, et ux., et al.': and
WHEREAS, Defendant, The Atchison Topeka and Santa Fe
railway Company, as to Parcel 35, as set forth in said action,
has offered to settle the foregoing litigation (as to said Parcel
35) for a total casn consideration of $11,800.00; and
WHEREAS, size City Council finds that said sum of
$11,800.00 is a fair and reasonable amount to pay for said land
and that it is in the best interests of the City to settle said
litigation.
NOW, THEREFORE, 3E IT RESOLVED by the City Council of
the City of Anaheim that it autnorize and direct, and it does
hereby autnorize and direct, tine Director of Finance to deliver
to the City Attorney's Office the sum of $11,800.00 made payable
to Tie Atchison, Topeka and Santa Fe Railway Company.
AND BE IT FURTHER RESOLVED that the City Attorne
and the is hereby, authorized to deliver said amount to said
Defendant when he either holds a grant deed to said property in
favor of the City of Anaheim, or has otherwise caused said
property to become vested in the City of Anaheim.
