A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
DECLARING THE NECESSITY, PURSUANT TO GOVERNMENT CODE
SECTION 39576.5, TO CONTRACT FOR THE REMOVAL OF WEEDS
AND RANK GROWTH GROWING UPON PUBLIC STREETS AND VACANT
LOTS, CALLING FOR BIDS THEREON, AND AUTHORIZING PUB»
LICATION OF NOTICE THEREFOR, WORK ORDER NO. 426 »297.
WHEREAS, The City Council has heretofore declared all
weeds and rank growth growing upon public streets and vacant lots
within the City of Anaheim to be a nuisance; and
WHEREAS, Government Code Section 39576.5 authorizes
the City Council to abate such nuisance by awarding a contract on
the basis of competitive bids for the removal of such weeds and
rank growth; and
WHEREAS, the City Council finds that public convenience
and necessity require that such weeds and rank growth be removed as
quickly as possible because of the noxious nature thereof, and further
finds the foregoing can best be accomplished by awarding a contract
therefor as aforesaid,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that all weeds and rank growth growing upon public
streets and vacant lots within the City of Anaheim be removed there»
from by contract on the basis of competitive bids, and that said bids
shall include the furnishing of all labor and equipment to cut and
remove all weeds and rank growth upon all lots and areas within the
City of Anaheim as directed by the Superintendent of Streets.
AND BE IT FURTHER RESOLVED that said bids shall specify
unit prices for the following area designations:
ITEM
1. City Lots, approx. 7,200 sq.ft.,
or under (TYPE "A" LOT)
2. City lots over 7,200 sq.ft. to
one »half acre in size
(21,780 sq.ft. TYPE "B" LOT)
3. One »half acre (21,780 sq.ft)
to one acre (43,560 sq.ft.)
(TYPE "C" LOT)
4. One acre (43,560 sq.ft.) and

BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim
be, and she is hereby authorized and directed to publish a notice according
to law, inviting sealed proposals for the furnishing of all labor and equip•
ment to cut and remove all weeds and rank growth upon all lots and areas
within the City of Anaheim as directed by the Superintendent of Streets,
and fixing the 20th day of April 1967, at the hour of 2 :00 P.M. as the date
and hour for the opening of said bids at the City Council Chamber in the
City Hall of the City of Anaheim, and that said notice shall be published
twice; the first of which publications shall be at least ten (10) days
prior to the date fixed for the opening of bids, and that said publications
shall be at least five (5) days apart.
AND BE IT FURTHER RESOLVED that the successful bidder or bidders
shall be required to enter into a contract with the City of Anaheim in the
manner and form approved by the City Attorney of the City of Anaheim for
the furnishing of the labor and equipment and the performance of the work
contemplated in said bid in accordance with the notice inviting sealed
proposals, this resolution, and all applicable City Ordinances or Code
Sections, and the laws of the State of California and shall be required to
post bonds and insurance in the amounts and within the time required by
law as specified in the notice inviting sealed proposals, and in a form
approved by the City Attorney.
THE FOREGOING RESOLUTION is approved and signed by me
this 21st day of March 1967.
