1968-122WHEREAS, the City Council dia on November 24, 1959 adopt Ordinance No. 1422 in Reclassification Proceedings No. 58-59-65 changing the property therein described from R-A, RESIDENTIAL-AGRICULTURAL 7,0E, to C-1, NEIGHBORHOOD ZONE, subject to certain conditions therein set forth; and follows: RESOLUTION NO. 63R-122 A aLsoLuTio1 OF THE CITY COUNCIL OI? WHEREAS, Condition No. 2 of said ordinance reads as '2. That the owner of subject property place of record standard City of Anaheim C-1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the C-1 uses of the property to Medical and Dental Offices, Professional Offices, Pharmacies, Flower Shops, Coffee Shops, and Rest homes; and shall limit the professional offices to two stories in height and all other buildings constructed on the property to one story in height. AND WHEREAS, said City of Anaheim C-1 Deed Restrictions were duly recorded in the Office of the County Recorder of Orange County, California on November 12, 1959, in Book 4969, Pages 420 to 424, both inclusive, Document No. 188229; and WHEREAS, the City Planning Commission did receive a request from Anaheim Eemorial Hospital, which is leasing certain property from Hillhaven Convalescent Hospital located on subject property, asking that said deed restrictions be amended to in- clude hospitals as a permitted use of subject property; and WHEREAS, the City Planning Commission did hold a public hearing on said request on January 29, 1968, and did adopt Reso- lution No. PC68-34 recommending to the City Council that said deed restrictions be amended to include hospitals as a permitted use; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did fix the 27th day of February, 1968 as the time and the Council Chamber in the City hall of the City of Anaheim as the place for a public hearing upon the proposed amendment of said deed restrictions, and did give due notice of said hearing as required by law; and WHEREAS, at the time and place fixed for said public hearing the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportu- nity to be heard and did receive evidence and reports, and did thereupon consider the recommendations of the City Planning Commission; and -1- 58-59-65 WHEREAS, the City Council does find and determine that said request should be granted and that said C -1 Deed Restric- tions should be amended by adding hospitals to the C -1 uses of subject property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the C -1 Declaration of Restrictions recorded on November 12, 1959 in Book 4969, Pages 420 to 424, both inclusive, Official Records of Orange County, California, Document No. 188229, be amended by amending Condition No. 7 thereof to read as follows: ATTEST: "7. The C -1 uses of subject property shall be limited to Medical and Dental Offices, Professional Offices, Pharmacies, Flower Shops, Coffee Shops, Rest Homes and Hospitals; and the Professional Offices shall be limited to two stories in height and all other buildings constructed on said property shall be limited to one story in height." BE IT FURTHER RESOLVED that in all other respects said Declaration of Restrictions shall remain unchanged. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby authorized to sign a consent to the amendment of said Declaration of Restrictions as hereinbefore outlined.
