92-056 RESOLUTION NO. 92R-~§ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE SHOULD NOT BE GRANTED IN A CERTAIN AREA OF THE CITY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 67-68-68 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described and, at said hearing, did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty (40) days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing and approved the proposed amendment; and WHEREAS, pursuant to the provisions of Section 18.03.085 of the Anaheim Municipal Code, the City Council caused the review of said Planning Commission action; and WHEREAS, at the time and place fixed for said public hearing, the city Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did consider the same; and WHEREAS, the city Council does find and determine that the property and area proposed to be changed from the zone or zones in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones in which it is now incorporated and that a change of zone should not be granted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: THE SOUTHERLY 95 FEET OF THAT PORTION OF LOT 1 OF "ANAHEIM EXTENSION", IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP OF SURVEY MADE BY WILLIAM HAMEL ON FILE IN THE OFFICE OF THE COUNTY RECORDER OF LOS AHGELES COUNTY, CALIFORNIA, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT IN THE NORTH LINE OF SAID LOT, BEING ON THE SOUTH LINE OF LA PALMA AVENUE, DISTANT THEREON 817.84 FEET WEST OF THE ~'~'~'~ ~ RECLASS #67-68-68 (8) NORTHEAST CORNER OF SAID LOT, SAID POINT BEING THE NORTHWEST CORNER OF THE LAND CONVEYED TO J.E. WALTER ET AL BY DEED RECORDED MAY 13TH, 1947 IN BOOK 1514, PAGE 377 OF OFFICIAL RECORDS, AND RUNNING THENCE SOUTHERLY ALONG THE WESTERLY LINE OF SAID LAND 209.41 FEET TO THE SOUTHWEST CORNER OF SAID LAND; THENCE SOUTH 73° 54' 25" WEST ALONG THE WESTERLY EXTENSION OF THE SOUTHERLY LINE OF SAID LAND 270.81 FEET, MORE OR LESS, TO THE WESTERLY LINE OF SAID LOT; THENCE NORTHERLY ALONG SAID WESTERLY LINE 288.00 FEET TO THE NORTHWEST CORNER OF SAID LOT; THENCE EAST ALONG THE NORTHERLY LINE OF SAID LOT, 281.07 FEET TO THE POINT OF BEGINNING. EXCEPTING THEREFROM THE EASTERLY 85 FEET, SAID 85 FEET BEING MEASURED ALONG THE SOUTHERLY LINE OF SAID PROPERTY. (hereinafter the "subject parcel") shall not be reclassified into the "RM-1200" RESIDENTIAL, MULTIPLE-FAMILY ZONE for the following reasons: 1. On April 30, 1968, the City Council did adopt its Resolution No. 68R-220 indicating its intention to reclassify certain properties described therein, including the subject parcel, from the R-1 (now RS-7200) Zone to the R-3 (now RM-1200) Zone, subject to the fulfillment of certain conditions precedent thereto as described in said Resolution No. 68R-220; and 2. On January 26, 1988, the City Council adopted General Plan Amendment No. 236 amending the Land Use Element of the General Plan of the City of Anaheim in a manner which reduced the maximum allowable density for development in certain areas of the City, a portion of which includes the subject parcel; and 3. As a result of the aforesaid General Plan amendment, reclassification of the subject parcel into the RM-1200 Zone would no longer be compatible with the Land Use Element of the General Plan; and 4. The City Council hereby determines that reclassification of the subject property into the RM-1200 Zone of the City of Anaheim is not required by the public necessity and convenience and general welfare BE IT FURTHER RESOLVED that City Council Resolution No. 68R-220 be, and the same is hereby terminated as to the subject parcel. - 2 - RECLASS #67-68-68 THE FOREGOING RESOLUTION is approved and adopted by the City Council of the city of Anaheim this 17th day of March, 1992.
