1968-092RESOLUTION NO. 68R -92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING AN EASEMENT DEED CONVEY- ING TO THE CITY OF ANAHEIM CERTAIN REAL PROPERTY FOR EASEMENTS FOR ROAD AND PUBLIC UTILITY, STORM DRAIN AND TEMPORARY CONSTRUCTION PURPOSES. WHEREAS, the City Council of the City of Anaheim is desirous of purchasing the hereinafter described real property for municipal purposes, to wit: Easements for road and public utility, storm drain and temporary construction purposes; and WHEREAS, the owners of said property have offered to sell and convey the same to the City; and WHEREAS, the City Council of the City of Anaheim finds that it is for the benefit and best interest of the City of Anaheim to accept said offer and purchase said real property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of JOHN W. HARTMAN and MADELYN M. HARTMAN, husband and wife, and ROBERT S. BORDEN and FLORENCE A. BORDEN, husband and wife,to sell to the City of Anaheim the following described real property situated in the City of Anaheim, County of Orange, State of California, to be used for easements for road and public utility, storm drain and temporary construction purposes, and more particularly described as follows: PARCEL ONE: An easement for road and public utility purposes over, under and across a strip of land 64 feet in width, being a portion of the South 140 feet, more or less, of the East one -half of the Northeast quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a Map thereof, recorded in Book 51, pages 7 et seq. of Miscel- laneous Maps, records of said Orange County, EXCEPTING therefrom the Easterly 40 feet of said land as conveyed to the State of California by deed recorded March 5, 1951 in Book 2153, page 254 of Official Records, and by deed recorded March 1, 1951 in Book 2151, page 460 of Official Records; the centerline of said strip of land being de- scribed as follows: Beginning at the most Northerly point of the centerline of Hayward Street, as shown on a Map of Tract 3823, re- corded in Book 203, pages 21 through 23 of Miscellaneous Maps, records of said Orange County; thence North 0 12' 10" West along the Northerly prolongation of the said cen- terline of said Hayward Street, a distance of 140 feet, more or less, to the point of terminus in the Northerly line of the said South 140 feet of the said East one -half of the said Northeast quarter of the said Southeast quarter of said Section 14. EXCEPTING therefrom the Easterly 40 feet of said land as conveyed to the State of California by deed recorded March 5, 1951 in Book 2153, page 254 of Official Records and by deed recorded March 1, 1951 in Book 2151, page 460 of Official Records. -1- PARCEL TWO: An easement for the installation and mainte- nance of a storm drain over, under and across that portion of the South 140 feet, more or less, of the East one -half of the Northeast quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a Map thereof, recorded in Book 51, pages 7 et seq of Miscellaneous Maps, records of said Orange County. EXCEPTING THEREFROM the Easterly 40 feet of said land as conveyed to the State of California by deed recorded March 5, 1951 in Book 2153, page 254 of Official Records and by deed recorded March 1, 1951 in Book 2151, page 460 of Official Records, described as follows: Commencing in the Southeast corner of the Northeast quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West; thence South 89° 36' 50" West a distance of 40 feet to the true point of beginning; thence continuing South 89° 36' 50" West a distance of 401.66 feet; thence North 0° 12' 10" West a distance of 10 feet; thence North 89° 36' 50" East a distance of 391.67 feet; thence North 44° 42' 19" East a distance of 14.16 feet; thence South 0° 10' 35" East a distance of 20 feet to the true point of beginning. PARCEL THREE: A temporary construction easement over, under and across the Northerly 15 feet of the Southerly 25 feet of the Northeast quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, pages 7 et seq. of Miscellaneous Maps, records of said Orange County. EXCEPTING therefrom any portion within Beach Boulevard. Said temporary construction easement to expire upon comple- tion of the installation of the storm drain. be, and the same is hereby, accepted by the City Council of the City of Anaheim, and that the City of Anaheim accept a convey- ance of said property. BE IT FURTHER RESOLVED that the City Auditor of the City of Anaheim be, and he is hereby, authorized to pay to the owner or owners of said real property, out of General Funds of the City of Anaheim, the sum of One Dollar ($1.00).
