A RESOLUTIO14 OF THE CITY COUNCIL OF ME CITY
OF ANAHEIK AUMORIZING AND DIRECTING THE
LZECUTIO11 OF AF. AGREEHENT WITH THE SOUTHERN
CALIFORNIA EDISON COL1PANY PERTAIHING TO THE
ADJUSTEL4T OF SALES TAX, IF ANY, IN CONNECTION
WITH COL1DLA:NATION PROCEEDINGS.
WHEREAS, the City Council of the City of Anaheim has
heretofore authorized the filing of a condemnation action, being
entitled "City of Anaheim vs. Southern California Edison Company,
et al.," Orange Count v Superior Court Case No. 156503; and
WHEREAS, in connection with the ultimate settlement
thereof there is a remote possibility that the State of California
may levy a sales tax upon certain of the property to be acquired
by the City of Anaheim; and
waap, in the event of such a levy it would be the
obligation of the City of Anaheim to include such tax in the
cost of the acquisition of the Edison facilities; and
WHEREAS, the City Council finds that the agreement
submitted by the Southern California Edison Company represents
a fair and equitable method of dealing with the contingency of
such a tax, and the execution of such agreement would be in tne
best interests of the City of Anaheirkin connection with the
settlement of the =eminent domain litigation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it authorize and direct, and it does
hereby authorize and direct, the Ti:a_yor and the City Clerk to
execute the agreement between the City of Anaheim and the Southern
California Edison Com2any as the same has been this date submitted
to tae City for execution.
THE FOREGOING RESOLUTION is approved and signed by me
this 30th day of January, 1968.
