1968-048WHEREAS, because of delay occasioned by the installa-
tion of the Metropolitan ;7ater District line within the area
covered by the improvement of Project No. 153, the City Engineer
of the City of Anaheim has recommended to the City Council that
Project No. 153, The Ball Road Street Improvement," from approxi-
mately 120 feet west of Knott Avenue to approximately 1340 feet
west of Knott Avenue, in the City of Anaheim, be abandoned at this
time and that no further work be completed under said project; ana
WHEREAS, the City Council has determined that the aban-
donment of such project would be equitable to the contractor and
would be in the best interests of the City of Anaheim; and
WHEREAS, Sully-Miller Contracting Company, the contrac-
tor to whom the job was let after competitive bidding, as set
forth in Resolution No. 65R-534, has agreed to cancellation of
the contract and has agreed to relinquish all claim for antici-
pated profits from said contract upon the payment of $331.63,
which represents the reasonable value of the work already com-
pleted under said Project No. 153, in addition to amounts hereto-
fore paid by the City in connection therewith.
NOW, THEREFORE, BD IT RESOLVED by the City Council of
the City of Anaheim that the contract between the City of Anaheim
and Sully-Miller Contracting Company, dated July 14, 1965, for
Project No. 153, "The Ball Street Improvement," from approximately
120 feet west of Knott Avenue to approximately 1340 feet west of
Knott Avenue, in the City of Anaheim, be, and the same is hereby,
cancelled and held for naught.
BE IT FURTHER RESOLVED that the Finance Director of the
City of Anaheim be, and he is hereby, authorized and directed to
pay the sum of $331.63 (after crediting additional sums hereto-
fore paid under said Project No. 153) as full and complete pay-
ment for work done under said contract, and as full compensation
to the contractor under said contract.
AND BE IT FURTHER RESOLVED that any bonds posted by said
Sully-Miller Contracting Company in connection with said Project
No. 153 be, and the same are hereby, declared to be fully exoner-
ated and discharged.
THE FOREGOING RESOLUTION is approved and signed by me
this 23rd day of January, 1963.
