1968-032WHEREAS, the City of Anaheim is the owner of the here-
in after described real property and
WHEREAS, said real property is no longer needed for
municipal purposes; and
WHEREAS, Thorobred Racing Plate Company, a partnership,
has offered to purchase said real property for the sum of
$48,690.00 cash, lawful money of the the United States and
'IaEREAS, the City Council finds that it is for the
benefit and best interest of the City of 2",naheim to accept said
offer and sell and convey said real property to said Thorobred
Racing Plate Company, upon the terms and conditions hereinafter
set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of Thorobred Racing Plate
Company to purchase the following described real property situ-
ated in the City of Anaheim, County of Orange, State of Califor-
nia, to wit;

A RESOLUTION OF 2HE CITY COUNCIL OF THE
CITY OF 1-iAHEIfl AUTHORIZING THE SALE OF
CERTAIN REAL PROPERTY AND AUTHORIZING
THE EXECUTION OF A CONVEYANCE ThERLOF.
All that portion of Lot 5, as shown on a 7..ap filed in
Book 2, page 39 of Record of Surveys, in the office
of the County Recorder of said County, and all that
portion of the Third Class Land allotted to Tomas
Yorba in Decree of Partition of the Rancho Canon de
Santa Ana, a certified copy of which was recorded
February 8, 1874 in Book 28, page 158 of Deeds,
records of Los Angeles County, California, conveyed to
the City of Anaheim, a municipal corporation, by deeds
recorded June 19, 1967 in Eook 8283, page 895 and
November 6, 1967 in Book 8427, page 46 of Official
Records of said County, lying Northerly of the following
described line:
Beginning at a point in the Westerly line of said land
conveyed by deed recorded in Book 8283, page 895 of
Official Records, said point being distant Northerly
250 feet, measured along said Westerly line, from the
Southwest corner thereof; thence Easterly to a point in
the Easterly line of said land conveyed by last-mentioned
deed, said point being distant thereon 282.38 feet
Northerly, measured along said Easterly line, from the
Southeast corner of said land conveyed by last-mentioned
deed.
EXCEPTING THEREFROM the Easterly 40 feet.
RESERVING ThEREFPON unto the grantor herein an easement
for the installation and maintenance of electric power
poles, lines and incidental equipment over, under and
across the Westerly 10 feet of the herein conveyed land.

for the sum of $48,690.00 cash, lawful money of the United
States, be, and the same is hereby accepted, upon the follow-
ing terms and conditions:
1. That said real property shall be sold and
conveyed subject to all covenants, conditions,
restrictions, reservations, rights, rights of
way and easements of record.
2. That in the event the Purchaser desires a policy
of title insurance, all costs of procuring said
policy shall be paid by the Purchaser.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute a good and suf-
ficient deed conveying to said Thorobred Racing Plate Company,
a partnership, the real property hereinbefore described, and
to deliver said deed to said Thorobred Racing Plate Company
upon payment of the full purchase price as hereinabove set
forth.
BE IT FURTHER RESOLVED that the City Clerk be, and
she is hereby authorized and directed to certify a copy of
this resolution and cause the same to be attached to the deed
to be executed by the Mayor and City Clerk on behalf of the
City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
