1968-013RESOLUTION NO. 68.R__13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1910 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from hUi BLL OIL i FI vING COI A vY owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of Lot 28 of Anahei_d Extension as snown on a i a_p by Wm. Hamel, a copy of which is shown in Book 3, :ages 162 to 1 inclusive, of Los Angeles County Naps, in the office of the County Recorder of Orange County, California, described as follows Beginning at the intersection of the Westerly prolonga- tion of the :North line of Ball Road with the inter- section of the center line of Harbor Boulevard, as describeu in deed to the County of Orange, recorded March 28, 1930 in Book 372, page 67 of Official Records; thence North 89° 46' 30' East along said. Westerly prolongation of said North line of Ball Road., a distance of 30 feet, pore or less, to the East line of said harbor Boulevard o thence continuing along said North line of Bali Road, 150 feet; thence North, at right angles to said North line of Ball Road, to the North line of the land described in deed to Edwin Emil Mettler and wife, recorded December 17, 1951 in Book 2264, page 590 of Official Records; thence South 89° 46' 30' West along said North line to said center line of harbor Boulevard.; thence South 11° 07' 30' West along said center line 158.48 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on Aucrust 28. 1967 notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC67 -191 recommending that Variance No 1910 be denied -1- and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission cuing said variance, and said appeal was set for public hearing on 9.= 3 1967 at 1 :30 o'clock P.M. at the City Hall in the City of Anaheim, and notice of such public hearing Was duly iven as required by law and the. provisions of Title 18, Chapter 1 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. L}. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted, for a period of five (5) years from date hereof, permitting the erection of two (2) free -standing signs on the property hereinbefore described, with waivers of the following Anaheim lunicipal Code requirements or liiitationsv (a) ilaximum number of free standing signs; and minimum distance between free standing signs (Section 18.62.090(13 -1)); (b) 'Maximum height of free standing signs (Section 16.62.090(13 -2)); (c) Maximum area of free standing signs (Section 18.62.090(3- 4 -a)); and (d) Location of free- standing signs distance from property lines (Section 18.62.090(E -5)), subject to the following conditions: 1. That adequate clearance of existing electrical lines shall be provided, as required by the Electrical Division of the Utilities Department and State of California G.O. 95. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns, to comply with the Anaheim T.unicipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. ATTEST: 2. That the new sign to be installed at the corner of a11 oad and harbor boulevard shall be set in such manner as to nave no encroachment into the future right of way; or, if placed in tne ultimate right of way, the petitioner shall execute an agreement, approved by the City Attorney, .providing for removal of said sign on demand of the City of Anaheim. 3. That subject property shall be developed sub- stantially in accordance with plans and speci- fications on file with the City of Anaheim, marked Exhibits L 1, 2, 3 and 4, the height of the sign behind the building, however, not to exceed seventy (70) feet.
