1968-012WHEREAS, Section 34090.7 of the California Government
Code provides that the legislative body of a city may prescribe
a procedure under which duplicates of city records less than
five (5) years old may be destroyed if they are no longer
required; and
WHEREAS, the Traffic Division of the Anaheim Police
Department has in its possession great quantities of duplicate
traffic citations issued to alleged traffic violators over the
course of many years; and
WHEREAS, the Chief of Police of the City of Anaheim
is desirous of clearing the files of the Traffic Division of
such duplicate traffic citations in order to provide adequate
storage space for current traffic citations; and
WHEREAS, the original traffic citations are kept on
file in the Municipal Court of the North Orange County Judicial
District; and
WHEREAS, the Chief of Police of the City of Anaheim
has determined that duplicate traffic citations which have been
kept by the Police Department for a period of one year from the
date of issuance of such citations are no longer of sufficient
value to be retained by the Police Department.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Anaheim does hereby authorize the Chief of Police
of the City of Anaheim to destroy such duplicate traffic cita-
tions as the Chief deems advisable provided that one year has
elasped since the date of issuance of said traffic citation.
BE IT FURTHER RESOLVED that the Chief of Police of
the City of Anaheim is hereby authorized to determine the proper
method of destruction, which method shall result in the complete
destruction of the duplicate traffic citations.
THE FOREGOING RESOLUTION is approved and signed by me
this 2nd day of January 1968.
