1967-606RESOLUTION N0. 67R -606 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 31st, day ,)f October 19 67 as the time, and the City Co c Chambers in. the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: -1- 67 -68 -21 A portion of Lots 1 and 2 of the Dominguez Estate, in the County of Orange, State of California, as per Map filed in Book 2, Page 15 of Record of Survey's in the Office of the County Recorder of Orange County and described as follows: Beginning at a point, said point being the intersection of the Northerly Right of Way line of Cicero Road, 64 feet in width, with the prolongation of the westerly boundary line of Tract No. 6303, thence northerly along said prolongation 850.03 feet to a point, said Point being the intersection of said prolongation with the Southerly Right of Way line of Santa Ana Canyon Road, thence southwesterly along said Right of Way line 673.00 feet more or less, thence southerly and parallel to the easterly line of the land as described per deed recorded in Book 524, Page 24 of Deeds, 850.03 feet, thence northeasterly and parallel to said Southerly Right of ;,ay line of Santa Ana Canyon Road to a point, said point being the intersection of the northerly Right of Way line of Cicero Road 64 feet in width, with the northerly prolongation of the westerly boundary of Tract No. 6303, said point also being the True Point of Beginning. be excluded from R-A, AGRICULTURAL ZONE, and incorporated in R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, upon the following condi- tions: ATTEST: 1. That a Final Tract Map of subject property shall be submitted to the City Council for approval and then recorded in the Office of the Orange County Recorder. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Super- intendent of Streets, prior to final building inspection. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation pure)oses, said amount to be paid at the time the building permit is issued. BE IT FURTEER RE that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
