1985-032RESOLUTION NO. 85R-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO THE LAND USE ELEMENT OF THE ANAHEIM GENERAL PLAN DESIG- NATED AS AMENDMENT NO. 187, EXHIBIT "B." WHEREAS, the City of Anaheim, pursuant to the recommendations of the Planning Commission of the City of Anaheim, adopted a General Plan for the City of Anaheim; and WHEREAS, on the 26th day of November, 1984, the City Planning Commission of the City of Anaheim did hold a public hearing to consider a General Plan Amendment. The General Plan Amendment does consider changing the land use designation for the area of land consisting of approximately 325 acres located generally as bounded on the north by the Bauer Ranch and Santa Ana Canyon Road, on the west by Anaheim Hills Development Corporation property and Bauer Ranch on the south by the Orla Hills Ranch and on the east by the Irvine Company property; and WHEREAS, at said public hearing, the City Planning Commission did duly adopt its Resolution Nq. PC84-241 containing a report of its findings, a summary of the evidence presented at said hearing, and recommending that said Amendment to the General Plan designated as Amendment No. 187 be adopted by the City Council changing the land use designation for the aforedescribed area to "Hillside Estate Density Residential, Hillside Low Density Residential, Hillside Medium Density Residential, General Commercial, School and General Open Space" in accordance with Exhibit "B"; and WHEREAS, upon receipt of said Resolution, summary of evidence, report of findings and recommendations of the City Planning Commission, the City Council did fix the 15th day of January, 1985, as the time, and the City Council Chamber in the Civic Center as the place for a public hearing on said proposed Amendment No. 187 and did give notice thereof in the manner and as provided by law; and WHEREAS, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports and did consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that Amendment No. 187 changing the land use designation in the aforedescribed area in accordance with Exhibit "B" on file with the City should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Amendment No. 187 to the General Plan changing the land use designation for the aforedescribed area to "Hillside Estate Density Residential, Hillside Low Density Residential, Hillside Medium Density Residential, General Commercial, School and General Open Space" in accordance with Exhibit "B" on file with the City be, and the same is hereby, approved. BE IT FURTHER RESOLVED that approval of said General Plan Amendment No. 187 is predicated and conditioned upon the following stipulations of the property owner which conditions shall be an integral portion of the Land Use Element of the General Plan applicable to said property: a. That the approval of the subject amendment does not guarantee the development of 1,119 dwelling units but provides for a range of from 0 to 1,119 dwelling units, with the actual number of units to be determined by the City at the time of the approval of the Planning Community (PC) Zoning and subdivision approval. b. That the future developments within the subject amendment area will conform with all of the requirements of the Anaheim Municipal Code Title Eighteen-Zoning (i.e. setbacks, parking, building heights, etc.) c. That the future developments within the subject amendment area will conform with all requirements of the Anaheim Municipal Code Title Seventeen-Land Development and Resources (i.e. grading, subdivision, etc.) d. That the applicant establish a mechanism to provide an on-going monitoring and transmittal of information to the City concerning future developments within the subject amendment area to insure that if the proposed magnitude of dwelling unit and commercial land uses, valuations, etc. vary from that described in the submitted fiscal impact report, that the positive fiscal impact to the City is maintained. BE IT FURTHER RESOLVED that the Planning Department be, and it is hereby, instructed to amend the General Plan Map to conform to General Plan Amendment No. 187 as herein adopted and approved. -2- THE FOREGOING the City Council of the January, 1985.
