1985-037RESOLUTION N0. 85R-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A LETTER OF UNDERSTANDING BETWEEN THE CITY OF ANAHEIM & THE ANAHEIM FIREFIGHTER'S ASSOCIATION WHEREAS, on August 21, 1984 the City Council adopted Resolution 84R-321 which approved a Memorandum of Understanding between the City of Anaheim and the Anaheim Firefighter's Association; and WHEREAS, the City Management Representative has consulted with the Anaheim Firefighter's Association concerning the amendment of the Memorandum of Understanding to provide for a ten hour work day and a 50 hour work week and a thirty hour work week on an alternating basis; and WHEREAS, as a result thereof a Letter of Understanding dated December 19, 1984 setting forth the terms and conditions for working the altered work schedule has been agreed to by the parties; and WHEREAS, the City Council of the City of Anaheim finds that adoption of said Letter of Understanding is in the best interests of the City of Anaheim. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated December 19, 1984 between the City of Anaheim and the Anaheim Firefighter's Association is hereby approved and adopted. SOH;, City Clerk of the City of Anaheim, do hereby certify that the foregoing is the original of Resolution No. 85R-37 duly passed and adopted by the Anaheim City Council on January 22, 1985. /C ,!i~~ CIT CLERK J LETTER OF UNDERSTANDING CITY OF ANAHEIM AND THE ANAHEIM FIREFIGHTERS ASSOCIATION It is the intent of this Letter of Understanding to set forth the terms and conditions under which the City will allow the Fire Inspectors of the Anaheim Fire Department to work an 10 (ten) hour day and a 50 (fifty) hour week and a 30 (thirty) hour week on an alternating basis. Scope All Fire Inspectors represented by the Anaheim Firefighters Association shall be covered by the terms of this agreement. Work Schedules 1. The work day shall consist of 10 (ten) hours of work plus a 1 (one) hour unpaid lunch period. 2. The work week will consist of 5 (five) days in one week of the bi-weekly pay period and 3 (three) days in the other week of the bi-weekly pay period on an alternating basis. Such schedule will be worked out with Fire Department Management. Overtime 1. The provisions of the Memorandum of Understanding governing overtime shall be superseded by the terms of this letter insofar as they apply to Fire Inspectors. 2. Fire Inspectors who perform authorized work in excess of the regular work week or work day as defined in this letter shall be compensated for such work at the rate of one and one-half times their regular hourly rate of pay. 3. Overtime designated as Compensatory time shall be in accordance with paragraph 37.3 of the Memorandum of Understanding. Holidays 1. Holidays shall be those as set forth in paragraph 30,0 of the Memorandum of Understanding and subject to all the terms and conditions of Article 30 including paragraph 30.2. 2. Fire Inspectors that avail themselves of the Holidays by not working will be required to submit a vacation request for 2 (two) hours for each Holiday so taken. Vacations and Sick Leave 1. Vacation and Sick Leave hours will accrue and be deducted in accordance with the provisions of the Memorandum of Understanding. ,m. ~„ Effective Date and Duration This amended work schedule shall become effective / ~ 5 85 At the end of `"~' 13 bi-weekly pay periods, the Department will review the progress and productivity of the group and the impact on operations and discuss with the Anaheim Fire Association the merits of continuing this altered work schedule beyond the 13 bi-weekly pay periods.
