1985-054RESOLUTION NO. 85R-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING PORTIONS OF HELENA STREET, CHESTNUT STREET AND THIRD STREET. (84-10A) WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 29th day of January, 1985, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation; and WHEREAS, the City Council does find, from the evidence submitted, that the street, highway or public service easement hereinafter specifically described is unnecessary for present or prospective public purposes including nonmotorized transportation facilities. WHEREAS, if and to the extent that there are in place public utility facilities in use for which easements are not reserved and excepted by this resolution, the City Council hereby determines that the public convenience and necessity requires that no easements be reserved for such facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of Third Street and portions of Chestnut and Helena Streets, more specifically described as follows: All that certain real property in the City of Anaheim, County of Orange, State of California, being portions of Helena Street (formerly Adelaide Street), Chestnut Street (formerly 2 Street South) and Third Street (formerly 3 Street South) all as shown on a map of "The Langenberger Track" as recorded in Book 1, pages 550 and 551 of Miscellaneous Records, in the office of the County Recorder of Los Angeles County, California, described as follows: Parcel 1: That portion of said Helena Street (61.00 feet wide), described as follows: Beginning at a point on the westerly line of Lot 64 of Block E5 of said Langenberger Tract, being distant N 14° 27' 24" W, 28.70 feet from the southwest corner of said lot, said point also being on the easterly right of way line of said Helena Street; thence S 73° 59' 23" W, 61.02 feet to the westerly right of way line of said Helena Street; thence along said westerly right of way line N 14° 27' 24" W, 288.50 feet to the beginning of a curve concave Southwesterly and having a radius of 15.00 feet, the westerly terminus of said curve being tangent to a line parallel with and (60.00 feet wide); thence Northwesterly along said curve through a central angle of 90° 05' 44" an arc distance of 23.59 feet; thence non-tangent to said curve N 14° 33' 07" W, 22.50 feet to a line parallel with and 10.00 feet Southerly of the centerline of said Chestnut Street; thence along last said parallel line N 75° 26' S3" E, 76.06 feet to said easterly right of way line of Helena Street; thence along said easterly right of way line S 14° 27' 24" E, 324.47 feet to the point of beginning. Parcel 2: That portion of said Chestnut Street (60.00 feet wide) lying easterly of the easterly right of way line of said Helena Street and lying westerly of the following described line: Beginning at a point on the northerly line of Lot 41 of Block E5 of said Langenberger Tract, being distant S 75° 26' S1" W, 16.01 feet from the northeast corner of said Lot 41, said point also being on the southerly right of way line of Chestnut Street; thence N 14° 34' 46" W, 60.00 feet to the northerly right of way line of said Chestnut Street. Parcel 3: That portion of Third Street (50.00 feet wide) lying easterly of the easterly right of way line of said Helena Street and lying westerly of the westerly line of Clementine Street (formerly Clementina Street) (61.00 feet wide) as shown on said Langenberger Tract. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded in the Office of the Recorder of ~"~ Orange County. -2- BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange at such time as all of the following conditions precedent to said vacation have been fulfilled: 1. All utility removals to be coordinated with Anaheim City Center Project. (Bids to be received December 20, 1984). 2. Existing electrical facilities to be removed. 3. Completion of new sewer to Clementine Steet. 4.
